Amanuensis Monday - Post 226: 1867 Deed of Land in Taylor County, Iowa from Tobias, Lydia and Robert Denny to Devier J. Smith

Genea-blogger John Newmark (who writes the excellent TransylvanianDutch blog) started a Monday blog theme years ago called "Amanuensis Monday."  John offers this definition for "amanuensis:" 

"A person employed to write what another dictates or to copy what has been written by another."

The subject today is an 1867 deed in the Taylor County, Iowa deed books for Tobias, Lydia and Robert Denny selling land in Taylor County to Devier J. Smith:


The transcription of this deed is (form blanks are underlined, and handwritten portions in italics):

RECORD OF DEEDS

1  T.W. & R.B. Denny to Devier J. Smith

2  Know all Men by these Presents:

3  That     Tobias W. Denny and L. Denny his wife and Robert N.
4  Denny              
5  of the County of     Bates     and State of       Missouri    , in consideration of the 
6  sum of      Fourteen Hundred     Dollars 
7  in hand paid by      Devier J. Smith    
8  of     Taylor     County and State of
9  Iowa      do hereby Sell and Convey unto the said     Devier J. Smith    
10  the following described premises, situated in the County of    Taylor     and State of     Iowa,   to wit:

11 The South west quarter of Section Twenty three (23) in Town
12  Ship Sixty Eight (68) of Range Thirty four (34) west, containing
13  one Hundred and Sixty acres more or less, also Lot number
14  Three (3) of Fractional Section number Eighteen (18) in town
15  ship number Sixty Seven (67) north of Range Thirty Three (33)
16  west containing Sixty acres and Seventy nine 79/100 of an acre.

17  and     we     hereby covenant with the said     Devier J. Smith    
18  that   we   hold premises by good & perfect title, that   we   
19  have good right and lawful authority to Sell and convey the same; that they are free and clear of all liens and incum-
20  brances whatsoever, and   we   covenant to Warrant and Defend the said premises against the lawful claims of
21  all persons whomsoever; and the said     Lydia Denny    hereby relinquishes
22  her right of dower in and to the above described premises.

This is a very straightforward land transaction from Tobias W. Denny, his wife Lydia Denny, and Robert B. Denny to Devier Smith (1839-1894).  Devier J. Smith had moved from Dodge County, Wisconsin to Taylor County, Iowa in about 1867 with his wife and growing family.  Devier J. Smith is my second great-grandfather.

Now I have two more pieces of land owned by Devier J. Smith to find.  At this time, he was only 28 years old.  He must have saved his money, or made money in land or some other property in the years since he was married in 1861.
