Amanuensis Monday -- 1899 Quitclaim Deed of Alexander Sovereen et al to the Village of Delhi for Land in Norfolk County, Ontario

 This week's document for transcription is the 1899 quitclaim deed of Alexander Sovereen,   Hannah V. Forbes, Miriam Carson and Albert Sovereen granting land to the Village of Delhi in Norfolk County, Ontario:

In the main body of the quitclaim deed on the right-hand page (page 635):

No. 93,571.

          This Indenture made in duplicate this twenty first 
day of April in the year of our Lord one thousand eight hundred 
and ninety nine .
          Between Alexander Sovereen of the Township of Windham 
in the County of Norfolk , farmer , Hannah V. Forbes, of the City of 
Brantford , in the County of Brant , married woman , Miriam Carson 
of the said City of Brantford , Widow , and Albert Sovereen of the said
City of Detroit in the State of Michigan , one of the United 
States of America , Doctor of Medicine , hereinafter called the 
Grantors of the first part and the municipal Corporation of the 
Village of Delhi in the County of Norfolk , hereinafter called the 
Corporation of the second part . 
         Whereas Frederick Sovereen late of the Township of Windham 
in the County of Norfolk , Farmer , deceased , was at the time of his 
death possessed of an estate of inheritance in the lands and premises 
hereinafter mentioned , and whereas the said deceased died on or 
about the day of AD. leaving him surviving two sons the above 
named Alexander Sovereen and William Sovereen , and Whereas the 
said William Sovereen departed this life on or about the 26th day 
of July A.D. 1892 leaving him surviving three children namely 
the above named Hannah V. Forbes , ( formerly Hannah V. Sovereen
the above named Miriam Carson formerly Miriam Sovereen ) and 
the above named Albert Sovereen . And whereas the said Grantors

are the only heirs at law of the said Frederick Sovereen who died 
intestate and whereas the said lands and premises hereinafter 
described were verbally set apart by the said Frederick Sovereen
for a public burial Ground and were used as such for some 
time , and whereas the said lands have not been used as a 
burial ground for some time and are being over ^run^ with weeds 
and are becoming unhealthy and unseemly in the Village 
of Delhi and the said Corporation is desirous of having the 
title to the said lands vested in the Village so that the graves 
may be removed to the Burial Ground now used and that 
the said lands may be turned into a Public Park under the 
name of  "The Sovereen Park" and Whereas the said Grantors
have agreed to execute these presents and to convey the said 
lands to the said Corporation on that consideration.
                 Now This Indenture Witnesseth that the said Grantors for 
and in consideration of the premises and of the sum of one 
dollar of lawful money of Canada to them in hand well and 
truly paid by the said Corporation at or before the sealing and 
delivery of these presents ( the receipt of which is hereby 
acknowledged , Have Granted , Released and Quitted Claim , and 
by these presents do Grant Release and Quit-Claim unto the 
said Corporations and its assigns forever all the Estate right 
title interest claim and demand whatsoever both at law and 
in equity or otherwise howsoever , and whether in possession 
or expectancy of the said Grantors , of in or out of.
                   All and singular those certain parcels or tracts of land and 
premises situate lying and being in the Village of Delhi in 
the County of Norfolk and Province of Ontario containing by 
admeasurement of an acre be the same more or less and 
being composed of Village Lots numbers Three and six in 
Block number seventeen according to plan " 24 B " of the said 
Village of Delhi . 
           Together with the appurtanences thereto belonging 
and appertaining 
            To Have and to Hold the aforesaid lands and premises 
with all and singular the appurtenances thereto belonging 
or appertaining unto and to the use of the said Corporation 
and its assigns forever . Subject nevertheless to the reservations 
limitations , and conditions expressed in the original Grant 
thereof from the Crown . 
               And the said Corporation hereby covenants with the said 
Grantors that they will turn the said lands into a Public 
Park and that the said Park will be known as " The Sovereen Park ".
              In witness whereof the said parties hereto have hereunto 
set their hands and seals .

                    to Wit  } of Norfolk merchant make oath and say : 1 . That I was 
personally present and did see the within instrument and duplicate 
thereof duly signed sealed and executed by Alexander Sovereen one of 
the parties thereto . 2 . That the said Instrument and duplicate were 
executed at the Township of Windham in the said County of Norfolk.  3.
 that I know the said party . 4 . That I am a subscribing witness to the 
said instrument and duplicate .

Sworn before me at the Village of Delhi in the County of Norfolk this 
22'nd day of April 1899 .

County of Brant   }  I William Arthur Hollinrake of the City of Brantford 
                To Wit  }  in the County of Brant Barrister make oath and say:
1 . That I was personally present and did see the within instrument 
and duplicate thereof duly signed sealed and executed by 
Hannah V. Forbes one of the parties thereto . 2 . That the said Instru-
ment and duplicate were executed at the said City of Brantford 3.
that I know the said party . 4 . That I am a subscribing witness to the 
said Instrument and duplicate .

                    to Wit  }  the County of Norfolk , Butcher make oath and say : 
1 . That I was personally present and did see the within Instrument and 
duplicate thereof duly signed sealed and executed by 
Miriam Carson one of the parties thereto . 2 . That the said Instru-
ment and duplicate were executed at the town of Simcoe in the 
said County of Norfolk . 3 . That I know the said party . 4 . That I am 
a subscribing witness to the said Instrument and duplicate .

this Twenty fourth day of April A.D. 1899 .

This is a Derivative Source (because it is a court clerk's transcription of the original quitclaim deed with Primary Information and Direct Evidence of the names of the two parties, and the dates of the quitclaim deed execution and recording.   

Note that the deed describes the original owner of the land in question (Alexander's father, Frederick Sovereen) and his two sons who inherited the land that was used as a burial ground. The graves are now in Delhi Cemetery in the village of Delhi, Norfolk County, Ontario.

Alexander Sovereen (1814-1907) was born 22 November 1814 in Middleton London District, Upper Canada, the son of Frederick and Mary Jane (Hutchison) Sovereen.  He died 15 August 1907 in Windham township, Norfolk County, Ontario.  Alexander married Elizabeth Putman (1820-1895) on 3 March 1840 in Norfolk County, Upper Canada.  She was the daughter of John Pieterse and Sarah (Martin) Putman.  They had 14 children.

Alexander and Elizabeth (Putman) Sovereen are my 3rd great-grandparents.  I am descended through their daughter Mary Jane Sovereen (1840-1874), who married James Abraham Kemp (1831-1902) in 1861.
