 Elizabeth Treat (1676-1755) is number 573 on my Ahnentafel List, my 7th great-grandmother, who married #572 Jabez Snow (1670-1750)  in about 1695  in Eastham, Barnstable County,  Massachusetts Bay.

Elizabeth Treat was born 24 July 1676 in Eastham, Massachusetts, the daughter of Samuel and Elizabeth (Mayo) Treat of Eastham[1-4].  She was the second of their eleven children.

She married Jabez Snow (1670-1750) in about 1695 in Eastham[1-2].  He was the son of Jabez and Elizabeth (Smith ) Snow of Eastham.  They had eight children, all born and recorded in Eastham town records.

*  Tabitha Snow (1707-1774), married (1) 1731 John Mayo (1707-1760); (2) Samuel Horton (1686-1778).
*  Samuel Snow (1709-1784), married 1732 Elizabeth Freeman (1714-1784).

*  Phebe Snow (1713-1754), married 1736 John Smith (1712-1754).

When her father, Reverend Samuel Treat, died in 1717, his will was first declared null and void, but was challenged by the heirs and then accepted by the Governor and the Council[5].  Each child of his first wife was to receive 5 shillings, "...they having already received a full share."

Her husband, Jabez Snow died 14 October 1750 in Eastham at the age of 80.  He is buried in Cove Burying Ground in Eastham. The will of Jabez Snow was written on 11 October 1743 and was proved on 23 January 1750/1 in Barnstable County Probate Court[6].  In his will, Jabez bequeathed property to his wife, Elisabeth:
"Itt I Give unto my Dear and Loveing Wife Elisabeth Snow one third part of all my Personall Estate forever that is to Say after my Just Debts & funeral Charges are paid Out of the Same & also I Give unto her my S^d Loveing Wife Elisabeth Snow the use & Improvement of my Dwelling house and barn & Orchard for her to use and Improve towards her Support During the time She Shall Continue to be my Widdow and I also Give unto her my Said Wife Elisabeth Snow the use and Improvement of one third part of all my lands & Meadows for her to use and Improve for her Support During y^e term of her Natural life."
Elizabeth (Treat) Snow died on 3 March 1755 in Eastham, at age 78[1-2,7].  She is buried in Bridge Road Cemetery in Eastham[7].  The inscription on the stone says:

"Here Lies The
Body of M'rs
Elizabeth Snow
Wife of M'r
Jabez Snow Died
March 3'd 1755
In Y'e 79'th Year
Of Her Age."

Jabez Snow was born 6 September 1670 in Eastham, Massachusetts, the son of Jabez and Elizabeth (Smith) Snow of Eastham[1-5].  He was the eldest of nine children.

He married Elizabeth Treat in about 1695 in Eastham[1-2].  She was the daughter of Rev. Samuel and Elizabeth (Mayo) Treat of Eastham.  They had nine children, all born and recorded in Eastham town records.

Jabez Snow died 14 October 1750 in Eastham at the age of 80[1-2,5].  He is buried in Cove Burying Ground in Eastham[5]

The probate records for Jabez Snow are in Barnstable County, Massachusetts Probate Court records[6].  The will of Jabez Snow was written on 11 October 1743 and was proved on 23 January 1750/1:
In the Name of God Amen I Jabez Snow in y^e County of Barnstable In the Province of y^e Massachusetts Bay in New England Yeoman being Arived to Old Age but through God's goodness Yet of Disposing mind and Memory do therefore now make this my last Will and Testament in Manner following that is to Say first of all I Commit my Soul to God y^t Gave it & my body to the Earth to be Decently buried.

Itt I Give unto my Dear and Loveing Wife Elisabeth Snow one third part of all my Personall Estate forever that is to Say after my Just Debts & funeral Charges are paid Out of the Same & also I Give unto her my S^d Loveing Wife Elisabeth Snow the use & Improvement of my Dwelling house and barn & Orchard for her to use and Improve towards her Support During the time She Shall Continue to be my Widdow and I also Give unto her my Said Wife Elisabeth Snow the use and Improvement of one third part of all my lands & Meadows for her to use and Improve for her Support During y^e term of her Natural life.

Itt I Give and bequeath unto my three Sons Namely Jabez Snow Silv^s Snow and Sam^ll Snow and to their heirs and Assigns forever all my Lands & Meadows and Real Estate Whatsoever to them in Equal Proportion in Equal Proportion Allike that is to Say two thirds thereof Next after my Decease & all the Remaining part next after my Said wife Elisabeth Snow Shall ^cease^ to have the Improvement thereof as above Expressed in this my Will & at the times above Expressed.

Itt I Give and bequeath to my three Daughters Namely Elisabeth Knowles Tabitha Mayo and Phebe Smith & to their heirs & Assigns forever in Equal Proportion Alike all and Every part of my Personal Estate not disposed of ^before^ in this my will and Testament that is to say after my Just Debts and funeral Charges are paid out of y^e whole thereof they my s^d Daughters having Each of them had Considerable heretofore.

Lastly I Do constitute Appoint Ordain and make my trusty Son Jabez Snow my whole and Soul Exec^r of this my last will and Testament Declaring this and no other to be my last will and Testament In Witness whereof I do hereunto Set my hand and Seal this eleventh day of Octo^r in the Seventeenth year of his Majesties Reign Anno Domini One thousand Seaven Hundred and fourty three.

Tombstone Tuesday -- Constance (Hopkins) Snow (1605-1677) in Cove Burying Ground, Eastham, Mass.

  I have collected a number of gravestone photographs from my own camera and from Find A Grave memorials over many years, and thought I would share them one at a time for Tombstone Tuesday.

Here is the gravestone of my 9th great-grandmother, Constance (Hopkins) Snow (1605-1677) in Cove Burying Ground in Eastham, Massachusetts.

The inscription on the relatively modern stone plaque says:

Tombstone Tuesday --Jabez Snow in Cove Burying Ground in Eastham, Mass.

I have collected a number of gravestone photographs from my own camera and from Find A Grave memorials over many years, and thought I would share them one at a time for Tombstone Tuesday.

Amanuensis Monday - 1773 Probate Papers for Jabez Snow (1696-1760) Estate in Eastham, Mass.

This week's documents for Amanuensis Monday are the 1772/3 Account on Settlement of the Estate and dividend on Dower in the probate court records for the estate of Jabez Snow (1696-1760) late of Eastham, Barnstable County, Massachusetts:

Eastham Gen^n Dec^d represented Insolvent presented the foregoing and made Oath that
it Contains a Just and true Account of his admin^n thereon which is Accepted & allowed

Barnstable Ss. By the Hon^e James Otis Esq^r Judge of Probate &c for said County.

It appearing to me by the Account of Willard Knowles of Eastham Esq^r Administ^r
of that ^third^ part of the Estate of Jabez Snow late of said Estham Gen^n Dece^d which was Sett
off to his Relict widow ^in dower^ who is since deceas^d. That said Estate was Sold at Publick
Vendue by order from the Court of Comon Pleas with the use thereof for the Sum of
ninety seven pounds fifteen shillings & Ten pence, and the Charges of
Administr & Selling &c amounts to the Sum of Nine pounds two Shillings
and six pence and the Debts due to the Creditors to said Estate appears
by the Comiss Report amounts to the sum of two hundred Eighty pounds
and four pence and also it appears by the Records in the Probate Office
that the former Executor paid Creditors the Ballance of his Acc^o amounting
two hundred twelve pounds six shillings and Eleaven pence so that
there there Remains due to said Creditors Anno 1761 the Sum of Sixty
seven pounds thirteen shillings & five pence which Sum with the Interest
since added thereto amounts to the sum of One hundred and Twelve pounds so
that said Estate will bear to pay the said Creditors no more than the sum of Six shil-
lings and four pence upon the pound of their Respective Debts & Interest more than
thet have already had.

I Do therefore proportion said Ballance and remaining Estate among the Creditors
accordingly and order the said administrator to pay to the said Creditors Six Shillings
and four pound more of the Debts to them respectively owing as appears by the
Comissioners Report & List of Debts hereto Annexed.

Jabez Snow and Elizabeth Paine (1702-1772) married in 1720 in Eastham, Massachusetts, and resided there for the remainder of their lives.  They had six children alive at the time Jabez wrote his will on 31 July 1760.  He died on 6 September 1760 and his wife Elizabeth died in 1772.  Elizabeth and their six living children were named in the will of Jabez Snow; the only married daughter at the time was Eunice Horting [Horton].

The will and inventory were transcribed in  Amanuensis Monday - Post 319: Probate Records of Jabez Snow (1696-1760) of Eastham, Mass.  The will is very simple - one third to the wife and the rest bequeathed to the six children.  The will of Jabez Snow was proved in the Barnstable Probate Court on 17 March 1761, and the Inventory was filed and approved on 9 May 1761.  

The probate records in this post were available on Ancestry.com but were not indexed.  I recently checked the Probate Index for Barnstable County and found these records that explain a lot more of what happened to the estate.  In Amanuensis Monday - 1761 Probate Papers for Jabez Snow (1696-1760) Estate in Eastham, Mass., I transcribed the Dower document, and the widow's one third portion of the real estate was set off by the committee.  In the Insolvency Report, the commissioners listed the debts owed by Jabez Snow to his creditors, totaling £282 0s 4d..  In the Account, the executor listed the income collected (£282 5s 6d), including the real estate sold at auction.  He also listed the charges, fees and other expenses incurred during his administration (£69 18s 1d).  The remaining estate was thus £212 6s 11d payable to the creditors.  In the Dividend, the Probate Court Judge ordered that the creditors be paid 15 shillings and 2 pence on the pound (about 75% of that owed) from the remaining estate.

Note that the executor sold off the two-thirds of the real estate that was bequeathed by Jabez Snow to his heirs, and charged himself with the personal estate.  It is very likely that the executor and his siblings bought at least some of the real property and all of the personal property in order to keep the house lot and other lands in the family.  The widow received a portion of the dwelling house and other lands.

In the present document, when the wife of Jabez Snow died in 1772, her one-third of the real property had to be sold at auction and the creditors paid up to what they were owed.  The sale amount, less the administrator's charges and payments, amounted to £ 88 13s 4p.  The Probate Court ordered the administrator to pay off the creditors at the rate of 6 shillings 4 pence to the pound.  Thus, the estate file was completed.  The creditors took a small loss of the money they were owed by the estate.

Jabez and Elizabeth (Paine) Snow are my 6th great-grandparents.  Their eldest child, daughter Eunice (Snow) Horton, who married Nathaniel Horton in 1742, is my 5th great-grandmother.

Amanuensis Monday - 1761 Probate Papers for Jabez Snow (1696-1760) Estate in Eastham, Mass.

Silvanus Bourn Esq^r Judge of Probate of Wills for the County of
Barnstable to make a Division and partition of the Real Estate of
Capt^n Jabez Snow Late of Eastham in said County Deceas^d by Setting
off to Elisabeth Snow Relict Widow to said Deceased one third part
thereof by Meets and Bounds as her Right of Dower is Accord-
ingly this third Day of July Anno Domini 1761; Have set off
to the Said Widow by meets and Bounds as followeth (viz) –

The Land Bounded beginning at the Northwest Corner of the
Orchad thence Runing Southerly thirty Rods by the way to a Stone
in the fence allowing a way from the Road Down to the House
two Rods wide and from said Stone thence Easterly Twenty Eight Rods
to a Stone in the Ditch thence still Easterly as the fence now Stands

Eastham in said county Gentleman Deceased Represented Insolvent
that the Funeral Expences Charges of Administration and Necessary
Implements of Household allowed the widow being first Subducted
there Remains but two Hundred Twelve Pounds Six Shillings and
Eleven Pence, and the Claims of the Several Creditors thereto as
Reported by the Comittee appointed to Receive and Examine
y^e Same Amounts to Two Hundred Eighty Pounds and four Pence
So that the Estate att Present will bear to Pay to the said Creditors
no more than fifteen shillings & two pence on the Pound of their
