Amanuensis Monday -- 1668 Will of John Fisher (1634-1668) of Medfield, Massachusetts Bay Colony

This week's document for transcription is the 1668 will of John Fisher (1634-1668) of Medfield, Massachusettd Bay Colony in the Suffolk County, Massachusetts Probate Court records.

The transcription of this document is:

"In the yeare of Our Lord one Thousand six Hundred sixty & Eight the 26th of the fourth month called June I John Fisher of Meadfield in the County of Suffolke in new England though by the afflicting hand of God upon mee being infirme & weake of body yet throguh his mercy whole & sound in my memory & understanding & not knowing how neere & sudden the time of my disolution may bee I doe therefore in the name & feare of God make & ordaine this my last will & Testament in manner & forme following -

"First I doe Commit my soule into the hande of Jesus Christ the Redeemer thereof & my body to the Earth after my decease to bee decently buryed in the discretion of my Executor.

"  Item I give & bequeath to Mary my deare & well beloved wife all that Estate whatsoever that I had with her that is soe much as is now in being & more one Feather bed upon which wee ordinarily lodge with all the bedding furniture belonging thereto Except that furniture about it that Came by my former wife Elizabeth & also the free use of that part of the House wherein I now dwell with free liberty of water & Convenient yard roome for wood & other her necessary occations with free Egres & regrese for her selfe her servants & assignes for & duringe all the whole time & tearme that shee shall remaine a widdow & unmarryed Provided & given with this Condition that shee at noe time take in any other dweller with her into the said House or any roome or roomes therein besides her child or children, & necessary servants  And more I also give & allow to Mary my sayd wife the right of the thirds or dower according to the Laws in that case Provided.  All which above bequeathed I give as aforesayd unto my sayd wife for & towards her Owne supply & maintenance & the Education & bringing up of that or children which the Lord hath or may yet give  mee by her.  Also I give unto my sayd wife one halfe of the Provissions that shall be in my House when the Inventory is taken.  

"Item  My mind & will is that after my decease a true Inventory bee made of my whole Estate Whereof I Give & bequeath to John Fisher my Eldest sonn a dubble Portion that is twice soe much thereof as any one of my other children to whome that is to say to my sonn Jonathan Fisher & my daughter Elizabeth Fisher & to that child that Mary my sayd wife now bee Conceived with, to Each of them an Equall Portion to bee payd & delivered to them & Each of them at that time as they shall severally claime lawfull Age or day of marriage, which soever shall come first only their parts in my sayd wives thirds only Excepted which they are not to Enter u[pon until after her decease.

"Item I give unto my sonn John those Curtains & vallance & bed & bedding thereto belonging that came by my first wife.

"Item  I give unto my daughter Elizabeth all her owne mothers wearing cloathes, both woolen & linnens silkes &c.  Also the Cubbert that stands in the House I give to my sonn John & all other things that came by my former wife that are not in Common use shall be devided betweene those my two Children John & Elizabeth & for that Estate or legacy that may yet come to my children by the gift of their Grandfathers unkle in England my mind & will is it shall be payd only to my two Eldest children last above named my sonn John to have a dubble Portion therein because it come to them in their Owne mothers right.

"And further my mind & will is that if it shall please God by death to take away Either of my two children John or Elizabeth before they attaine Lawfull Age or marriage as aforesayd that then they portion shall goe, one third of it to the survivor of them two, one third part to my Child or Children that I have or may have by Mary my aforesayd wife the other third part to goe to the Children of my Brother Josiah Fisher & the children of my sister Mary Batle, two thirds of it to my Brothers children one third of it to my sisters children to bee divided Amongst them, at the discretion of their Fathers or Parents And according to that Proportion according to that Generall Rule the Estate the Estate to bee divided if God please to take away any of my children before they come to Lawfull age or marriage.

"Item I doe nominate Constitute & ordaine my dearly beloved Brother Joshua Fisher of Deadham & my well beloved Couzen Ensigne Daniell Fisher of that Towne to bee my Executors for the due Execution & performance of this my last will as it is above written & for the receiving of all debts due to mee & for the payment of whatsoever debts I owe unto any man & to doe whatsoever otherwise may Conserne them as my Executors & my mind & will is that they should bee fully sattisfyed & payd for their Care service & paines for this their undertaking out of my Estate.

"And I further will & declare that my mother Ann Fisher may Enjoy that part of the House my Father & shee live in instead of that End that I live now in which shee is to have during her life with one row of Apple Trees, as is Expressed in my deed from my Father to mee.  But my will is shee should have free Egress & regress for water yard roome and for her necessary occations if shee should rather Choose that End than the part of the House shee now live in which is my desire shee should Enjoy with the bennifit of halfe the Orchard & meane that part of the house wherein now shee live.

"And I further name & intreat Our Reverind Pastor mr John Wilson & my deare & Lovinge Father Josiah Fisher both of Meadfield abovesayd to be Overseers to this my above written will & to bee assisting to my afore named Executors about the disposing of my two Eldest children to whome Care & trust & Commit them to bee placed And for to provide for in Education & otherwise, as the greater number shall see best for the sayud Children from time to time.

"As for that child God hath given mee by Mary my wife I leave to her Care to provide for & dispose of as shee shall see best.

"In Wittnes whereof I the sayd John Fisher have hereunto subscribed my hand & affixed my seale the day & yeare above named.

"At a County Court held at Boston 28 July 1668 Mr. John Wilson & Samuell Bullen deposed that having subscribed their names as wittnesses to this instrument that they were prsent on the date thereof & that they saw & heard the sayd John Fisher to signe seale & publish the same to be his last will & Testament that when hee soe did hee was of a sound disposing mind to their best knowledge."

This is a Derivative Source (because it is a court clerk's transcription of the original handwritten will) with Primary Information and Direct Evidence of John Fisher's spouses and children at the time it was written.  There were no other records for John Fisher's estate found on Ancestry.com, but there may be an inventory and account in other probate records.

John Fisher (1634-1668) was born before 26 January 1633/4 in Redenhall, Norfolk, England, the son of Joshua and Elizabeth (--?--) Fisher.  He died 3 July 1668 in Medfield, Massachusetts Bay Colony.  John married (1) Elizabeth Boylston (1640-1665) on 6 April 1658 in Watertown, Massachusetts Bay Colony.  They had four children:

*  Elizabeth Fisher (1659-1694), married 1678 John Plimpton (1649-1704).
*  John Fisher (1661-1755), married 1683 Mary Metcalf (1652-????).
*  Thomas Fisher (1663-1663)
*  Esther Fisher (1665-1666).

After Elizabeth (Boylston) Fisher died in 1665, John Fsher married (2) Mary Treadway (1642-1677) on 21 September 1665 in Sudbury, Massachusetts Bay Colony.  They had two children:

*  Jonathan Fisher (1666-1751), married 1695 Rachel Fairbank (1672-1747).
*  Nathaniel Fisher (1668-1668).

John and Elizabeth (Boylston) Fisher are my 9th great-grandparents.  I am descended through their daughter Elizabeth Fisher (1659-1694) who married John Plimpton (1649-1704) in 1678.

Know all Men by these Presents That we Joshua
Fisher of Walpole Husbandman Samuel
Mors Blacksmith and Timothy Hammon Hus-
bandman of Medfield all within the County of Suffolk
are holden and Province of the Massachusetts Bay
in New England, are holden and stand firmly
bound and obliged unto Samuel Sewall Esq.
Judge of the Probate of Wills &ctt or his Successors
in s'd Office in the full and just Sum of four hundred
and fifty pounds current money in New England
to be paid unto the said Samuel Sewall his Successors
in s'd Office or assigns To the payment whereof
we do bind our Selves & Each of us our & Each of our
heirs Executors & Admin'rs joyntly & severaly for
the whole and in the whole firmly by these presents.
Sealed with our Seals Dated this Twenty Second
day of November In the Second year of the Reign
of our Sovereign Lord George the Second over
Great Britiain &c 1728.

The Condition of this present Obligation is such
That whereas the Real Estate of John Fisher late of
Medfield Blacksmith deceased Intestate not admitting of
a Division among all his Children without great
prejudice or Spoiling of the whole being apprized
at the Sum of Two hundred and thirteen pounds & five
shillings is assigned unto the within Bounden Joshua Fisher
he paying thereout unto his eldest Brothers Children vz't the
Heirs of John Fisher Jun'r deceased ^£47-7-9^ & to his Sisters
Namely Hannah Parteridge ^deced^ or her heirs Rachel Boyden ^decd^
or her heirs & Mehitabel Bullen or their Legal Representatives
the Sum of Twenty three pounds, thirteen shillings & ten pence
half penny apeice in Current lawfull money of New England
or Bills of publick Credit on this Province on or before the
Twenty Second day of November which will be in the year
of our Lord one Thousand Seven hundred & twenty nine

with Interest for the said Sums in the Interim
at the rate of Six pC't pr Annum being their
single shares of Two Third part of their
said Father's Real Estate at present and
at and upon the Death of their Mother
Hannah Fisher or other the Determination 
of her term in the premises the further sum
of twenty three pounds thirteen shillings
& ten pence half penny to the heirs of the Eldest
Son John Fisher aforesaid and to the Rest of
the Children or those that represent them
the further Sum of Eleven pounds Sixteen
Shillings and Eleven pence a peice to
Compleat their Respective Shares of and in
their said Fathers Real Estate.  Now if therefore
the said Joshua Fisher perform in the Decree
of the said Judge of Probates by paying
the abovesaid sums of money with Interest
 in Manner & true as before Expressed without
fraud coven or further delay then the within
written obligation to be void & of none Effect
or otherwise to remain in full force & vertue.

John Fisher (1652-1727), a blacksmith, married Hannah Adams (1656-1746) in 1674 in Medfield, and he died 15 October 1727 in Medfield.  They had seven children, but one died as a child, and three others died before the death of their father in 1727 and left children, and one child (Josiah Fisher) is not named in the probate records for some reason (he was probably deeded land by his father as his share).  A list of the children of John and Hannah (Adams) Fisher that are named in the list of heirs on image 17 are:

*  Joshua Fisher [named administrator of the estate]
*  John Fisher Jr. [eldest son, died in August 1727, had children]
*  Hannah Partridge [daughter, wife of William Partridge, died before her father, had children]
*  Rachel Boyden [daughter, wife of Jonathan Boyden, died before her father, had children]
*  Mehitable Bullen [daughter, wife of John Bullen, has children]

On 16 October 1727, Joshua Fisher (son of the deceased John Fisher Senior) was appointed administrator of his father's estate.  An inventory was immediately taken (see Image 7 above) that totaled £313-11-02, of which £213-05-00 was real property.  On 16 October 1728, the widow Hannah (Adams) Fisher petitioned the court (see Image 10 above) for her widow's thirds and complained that the land she inherited was not in her husband's inventory and it should be her property.  On 12 November, the real property was inventoried and totals £213-05-00 (see Image 15 above), so it was not included in the property to be divided by the children.  The administrator filed his account on 25 October 1728.  

A committee decided that the property should be awarded to son Joshua Fisher (since son Josiah had his own property) and eldest son John Fisher Jr. was deceased, with Joshua to pay his siblings or their representatives their shares in money of their father's estate, and when their mother died, their share of her estate also.  Their were six shares for five children (the eldest son receives a double share), so a share of the father's estate for each child was £23-13-10, and a share of them other's estate was £11-16-11.  The probate court ordered this on 22 November 1728 to be completed by 22 November 1729.

John and Hannah (Adams) Fisher are my 8th great-grandparents, through their son John Fisher (1677-1727) who married Abigail Smith (1686-1725) in 1705 in Medfield.

The humble Petition of the Widow of John Fisher
Senior late of Medfield Deceased – most humbly sheweth

That it pleased God to take away my Husband
from me by Death not long since and I am
left a widow in my old age under low and dif-
ficult Circumstances for my Husband was prevailed with
to give away a considerable part of his lands to his
Children by Deeds and left but little as I may say
undisposed of and the case is so circumstanced
that my Thirds which is almost the onely
Support I have to depend upon amounts to but
little and some of my Children are not willing I
Should have that in so agreable a manner as I could
wish and as I think I ought to have.
And there is two acres of Meadow that of Right
belongs to me for I have an hereditary right
to it insomuch that at the first apprizement of
my Husbands Estate it was not put into the Inven-
tory Yet notwithstanding ^it is^ since apprized as part of my
Husband's Estate, and I am like to be deprived of my
Right, unless your Hon'r will be pleased in your
Wisdom and Compassion to help me. Wherefore
I Do most humbly and earnestly pray Your Hon'r
if it seem meet to you to order y't I may have my
Thirds Sett out to me near home where it may be most
beneficial to me, and that I may not be deprived
of my said two acres of Meadow, which being grant-
ed your humble Petitioner as in Duty Bound
Shall ever pray.

John Fisher (1652-1727), a blacksmith, married Hannah Adams (1656-1746) in 1674 in Medfield, and he died 15 October 1727 in Medfield.  They had seven children, but one died as a child, and three others died before the death of their father in 1727 and left children, and one child (Josiah Fisher) is not named in the probate records for some reason (he was probably deeded land by his father as his share).  A list of the children of John and Hannah (Adams) Fisher that are named in the list of heirs on image 13 are:

John Fisher ^of Medfield^ Blacksmith Josiah Fisher of Dedham 
Husbandman & Samuel Smith of Medfield Husbandman,
all in the County of Suffolk & Province of the Massa-
chusets Bay in New England are holden & Stand firmly
bound & obliged unto Josiah Willard Esq'r Judge of
the Probate of Wills and for Granting Letters of Administration
in the County of Suffolk in the full & Just Sum of
Seven hundred & Sixty eight Pounds Curr't Money of
New England to be paid unto the s'd Josiah Willard Esq'r
his Successors in the said office or assigns to the which
Payment well & truly to be made, We bind ourselves
our & Each of our Heirs, Exec'rs Admin'rs & acting as Jointly
& Severally in the whole and for the whole firmly by
these Presents Sealed with our Seals.  Dated the 19'th

The Condition of the above Obligation is such That Whereas
the Real Estate of John Fisher late of Medfield in the County of
Suffolk Blacksmith deced Intestate Cannot Admit of a Division among

Sum of Three hundred Eighty Four Pounds is assigned unto his Eldest
Son John Fisher the above bounden he paying thereout unto his Broth'r
& Sisters or their Legal Representatives Namely Abigail Plimpton
Sarah Fisher and Joshua Fisher the Sum of Seventy Six Pounds Sixteen
Shillings a peice on or before the Sixteenth Day of September which
will be in the Year of our Lord One thousand Seven hundred and

Thirty six with Interest for the said Sums in the Interim after
the Rate of Six pounds p'r Cent p'r Annum being their Single Shares of
and their s'd Father's Real Estate.  Now if therefore the said John
Fisher fulfill the Decree of the said Judge of Probate by Paying the
aforesaid Sums of Money with Interest as aforesaid without fraud
Coven or further Delay, then the obligation to be Void & of none Effect
Otherwise to abide & Remain in full force and vertue.

John Fisher (1677-1727), a blacksmith, married Abigail Smith (1686-1725) in 1705 in Medfield, and he died 14 August 1727 in Medfield.  They had seven children, but three of the children died before 1727, leaving four children  - Abigail (aged 15), John (age 13), Sarah (age 8) and Joshua (age 2) at John's death in 1727 as heirs to his property.  

Josiah Fisher was appointed administrator of the estate of his brother, John Fisher (1677-1727), on 16 October 1727 by the Suffolk County Probate Court.  The Inventory of the personal and real property was taken on 20 October 1727 appraised at £531-06-08, and was approved by the Court on 5 December 1727.  The Real Estate was valued at £353.  The administrator provided an Account that was approved by the Court on 25 October 1728.  The estate was not distributed until September 1735, after the eldest son was age 21.  The Court required an appraisal of the real estate, which was £384, and awarded all of the real property to the eldest son John, and he to pay equal shares of £76-16s  to his three siblings, Abigail, Sarah and Joshua.  Since the real estate was appraised to be £384, each of five shares (the eldest son having two shares by law), was 76 pounds 16 shillings.

John and Abigail (Smith) Fisher are my 7th great-grandparents, through their daughter Abigail Fisher (1711-1785) who married John Plimpton (1708-1756) in 1731.

52 Ancestors - Week 345: #555 Abigail (Smith) Fisher (1686-1725) of Medfield, Massachusetts

Abigail Smith (1686-1725)  is number 555 on my Ahnentafel List, my 7th great-grandmother, who married #554 John Fisher (1677-1727)  in 1705 in Medfield, now Norfolk County, Massachusetts.

Abigail Smith was born 18 December 1686 in Medfield, Massachusetts, the daughter of Samuel Smith and Sarah Clarke[1].

Abigail Smith married John Fisher on 23 April 1705 in Medfield[2].  He was born 22 December 1677 in Medifield, the son of John Fisher and Hannah Adams.  John and Abigail (Smith) Fisher had seven children, all born in Medfield and recorded in the town record book:

*  Solomon Fisher (1706-1706).
*  Abigail Fisher (1707-1711).
*  Sarah Fisher (1709-1785).
*  Abigail Fisher (1711-1785), married 1731 John Plimpton (1708-1756).

Abigail (Smith) Fisher died 23 February 1724/5 at age 38[2], just days after the birth of her youngest son Joshua Fisher, leaving four children aged 0 to 13 without their mother.  

There is no burial record available for Abigail (Smith) Fisher, but she may have been buried in Vine Lake Cemetery in Medfield.
