Amanuensis Monday - Post 337: 1870 Deed of Conveyance from Manning Knapp to Sarah Auble in Terre Haute, Vigo County, Indiana

Genea-blogger John Newmark (who writes the excellent  TransylvanianDutch blog) started a Monday blog theme years ago called "Amanuensis Monday."  John offers this definition for "amanuensis:" 

"A person employed to write what another dictates or to copy what has been written by another."

The subject today is the deed of conveyance from Manning M. and Anna M. Knapp to Sarah G. Auble for land in Terre Haute, Vigo County, Indiana:

This Indenture the Thirtieth day of July in the year One Thousand
Eight Hundred and Seventy Between Manning M. Knapp and Anna M. his
wife of the Township of New Barbadoes in the County of Bergen and State of New
Jersey of the part And Sarah G. Auble wife of David Auble of the City of
Terre Haute in the County of and state of Indiana of the second part.

Witnesseth That the said party of the First Part, for and in consideration of the sum
of Two Thousand dollars lawful Money of the United States of America to them
in hand well and truly paid by the said part of the Second Part, at and before
the sealing and delivery of these presents, the receipt whereof is hereby acknowledged
and the said party of the First Part therewith fully satisfied, contented and paid, Have
given, granted, bargained, sold, aliened, released, conveyed and confirmed, and by these
presents do give, grant, bargain, sell, alien, release, convey and confirm to the said party
of the Second Part, and to her Heirs and Assigns forever. All that Lot, Tract or Parcel of
Land and Premises, hereinafter particularly described, situate, lying and being
in the of in the County of Vigo and State of Indiana.

Being part of Outlet Number 16 (Sixteen) in the City of Terre Haute Indiana, and
Bounded as follows, viz. Commencing at the Northwest corner of said lot, and run-
ning thence South seventy four feet six inches (74^ft 6^in) thence East one hundred and
forty one feet two inches (141^ft 2^in) thence North seventy four feet six inches (74^ft 6^in) and
thence West to the place of Beginning Subject to a Mortgage to John Burton, declar-
ed being the same property conveyed to said Manning M. Knapp by Jacob H.

Ebedo & wife by deed dated February 7, 1867. Together with all and singular the
tenements, hereditaments, easements and appurtenances belonging or appertain-
ing thereto and the reversions, remainders, rents, issues and profits thereof.
And also all the estate, right, title, interest, Dower/right of Dower property, poss-
ession, claim and demand whatsoever of the said party of the first part of
in and to the same, and every part and parcel thereof. To Have and to Hold
all and singular the above granted and described land and premises with
the appurtenances. Unto the said party of the second part, her heirs and assigns,
to her and their only proper use, benefit and behoof forever.

And the said Manning M. Knapp doth for himself his Heirs, Executors and
Administrators, covenant and grant to and with the said party of the Second
Part her Heirs and Assigns, that he the said Manning M. Knapp is the
true, lawful and right owner of all and singular the above described Land
and Premises and of every part and parcel thereof with the appurtenances
thereunto belonging. And that the said Land and Premises, or any part thereof
at the time of the sealing and delivery of these presents, are not encumbered
by any Mortgage, Judgement, or Limitation, or by any encumbrance whatsoever,
except as before stated by which the title of the said part of the Second Part hereby
made or extended to be made for the above described Land and Premises, can or
may be changed, charged, altered or defeated in any way whatsoever. And also,
That the said party of the First Part, now have good right, full power and lawful
authority to grant, bargain, sell and convey the said Land and Premises, in
manner aforesaid. And also that he will Warrant, Secure and forever Defend
the said Land and Premises unto the said Sarah G. Auble her Heirs and Assigns
forever, against the lawful claims and demands of all and every person and
persons freely and clearly freed and discharged of and from all manner of en-
cumbrances whatsoerver.

In Witness Whereof, The said part of the first have hereunto set their hands
and seals the day and year first above written.

Be it remembered that on the first day of August in the year one thousand
eight hundred and seventy, before me a Notary Public of the State of New Jersey
personally appeared Manning M. Knapp and Anna M. his wife who I am
satisfied, are the grantors in the within Deed of Conveyance named, and who

executed the same and I having first made known to them the contents there-
of, they did thereupon acknowledge that they signed, sealed and delivered the
same as their voluntary act and deed for the uses and purposes therein expressed.
And the said Anna M. wife of the said Manning being by me privately exam-
ined, separate and apart from her said husband, did further acknowledge
that she signed, sealed, and delivered the same as her voluntary act and deed,
Truly and without any fear, threats or compulsion of or from her said husband.

I Cornelius L. Blauvett, Clerk of the County of Bergen, and also Clerk of Circuit
Court and Court of Common Pleas (Courts of Record) do hereby certify that Garret
Ackerson Junior, Esquire, whose name is subscribed to the certificate of the proof or
acknowledgment of the annexed instrument, and thereon written, was at the time
of taking such proof or acknowledgment a Notary Public in and for said County,
dwelling in the said County, and duly sworn. And further, that I am well
acquainted with the handwriting of the said Notary Public and verily believe
that the signature to the said certificate of proof or acknowledgment is genuine.
In Testimony Whereof, I have hereunto set my hand and affixed the Seal of

Sarah G. (Knapp) Auble (1818-after 1900) is my second great-grandmother, married to David Auble (1817-1894).  They moved from New Jersey to Terre Haute, Indiana in the mid-1860s and settled there, as did one of Sarah's brothers, Charles C. Knapp (1813-1888), and one of Sarah's sisters, Elsie M. (Knapp) Wilson (1831-1913).  I don't know exactly when David and Sarah Auble moved to Terre Haute.  David was a shoemaker.

Manning M. Knapp (1825-1892) was the youngest brother of Sarah, and was wealthy.  It may be that he bought this parcel of land in 1867 thinking he would move to Terre Haute, or perhaps he bought it as an investment.  He was an attorney in Bergen County, New Jersey 1867, and was appointed to the New Jersey Supreme Court in 1875 and he died in court in 1892.  His wife was Anna (Mattison) Knapp (1827-1899).  They resided in New Bardadoes, Bergen County for many years.

It may be that Manning Knapp, being perhaps the wealthiest of the family, purchased lots in Terre Haute and then sold them to his siblings.  I haven't searched for other deeds for Manning Knapp or the other Knapp siblings.

Unfortunately, the Deed does not provide a clear location for this parcel of land.  It was 74.5 feet by 141.2 feet, or 10,519 square feet, which is 0.24 acre.  I know from the 1880 U.S. Census record for Terre Haute that the David Auble family resided at 411 Chestnut Street in Terre Haute.  That is probably the site of the land parcel in this deed.

This deed was the only deed for an Auble in Vigo County between 1860 and 1880.  This deed series goes up to 1886.  David Auble died in 1894.  It may be that Sarah sold the land after 1880, or it may be that it was sold as part of her estate, if there was one.  I will have to investigate this deed series again, and find a later deed series either at the FHL or in Terre Haute.
