Amanuensis Monday -- 1816 Mortgage Deed of Nathan Gates to John Miles in Gardner, Massachusetts

This week's document for Amanuensis Monday is the 1816 mortgage deed of  Nathan Gates selling land to John Miles in Gardner, Massachusetts in the Worcester County, Massachusetts Land Records:

Know all Men by these presents that I Nathan Gates of Gardner

in the County of Worcester and Commonwealth of Massachusetts Yeoman
In consideration of two hundred and sixty three dollars paid by John Miles
of said Gardner in said County Yeoman -- The receipt whereof I do
hereby acknowledge do hereby give grant sell and convey unto the said John
Miles his heirs and assigns a certain tract of land situated in said Gard-
ner being the farm the farm on which I now live lying northerly of the Coun-
ty road leading from Westminster to Winchendon containing about forty
Acres with the buildings thereon and is bounded southerly on said county
 road northeasty on land of Henry Coolidge northesterly on the fourth
division lots northwesterly on Aaron Conant being the same land which
I mortgaged to the Boston bank for the sum of four hundred dollars.

To have and to hold the aforegranted premises to the said John Miles
his heirs and assigns to his and their use and behoof forever and I do covenant
with the said John Miles his heirs and assigns that I am lawfully seized
in fee of the aforegranted premises except the aforesaid Mortgage that they are
free of all incumbrances that I have good right to sell and convey the same to
the said John Miles and that I will warrant and defend the same premises to the
said John Miles his heirs and assigns forever against the lawful claims and

demands of all persons - Except the Mortgaged Deed aforesaid and a
prior Mortgage given by the said Gates to said Miles.

Provided nevertheless that if the said Nathan Gates his heirs
Executors or Administrators pay to the said John Miles his heirs Exec-
utors Administrators or assigns the sum of two hundred and sixty three
dollars in one year and five months with interest annually then this
Deed as also a certain note of hand bearing even date with these pres-
ents givin the said Gates to the said Miles to pay the same sum of two
hundred and sixty three - at the time aforesaid shall both be void
otherwise shall remain in full force.  In witness whereof the said
Nathan Gates and Abigail wife of the said Nathan in token of her
relinquishing her right of dower in and to the premises have hereunto
set out hands and seals this eighteenth day of September in the year of
our Lord one thousand eight hundred & sixteen.

In this deed, Nathan Gates, yeoman of Gardner, sold a 40 acre tract of land  in Gardner to John Miles, yeoman of Gardner for 263 dollars.  Nathan Gates owed a mortgage of $400 to a Boston bank at the time, and this deed would be void if Nathan Gates paid $263 with interest to John Miles within one year and five months.  The earlier deed mentioned is a mortgage deed for $300 sold in February 1816.  Apparently, Nathan Gates was having trouble paying off his debts, particularly the Boston Ban loan of $400.

Nathan Gates (1767-1830), who married Abigail Knowlton (1774-1855) in 1790, is my 4th great-grandfather.  I am descended from their daughter, Abigail Gates (1797-1867) who married Benjamin Seaver (1791-1825) in 1817.
