Amanuensis Monday -- 1828 Deed of Heirs of Rudolph Spangler to Daniel Spangler For Land in Mercer County, Pennsylvania

Rudolph Spangler heirs } To all to whom these presents shall come Dorothea Spang-
            to                        } ler widow & relict of Rudolph Spangler late of the Borough 
Daniel Spangler            } of York in the County of York and State of Pennsylvania 
                                       } deceased . Jacob Spangler Jesse Spangler , George Barnitz in 
right of his late wife Catharine who was one of the daughters of said deceased who 
is dead, Elizabeth Nes widow who is also one of the daughters of said Rudolf
 deceased Charles F. Fisher and Helena his wife another of the daughters of the 
said deceased all of the County York aforesaid and Joseph Slagle and Mar-
garet his wife another of the daughters of the said deceased of the town of Winchester in 
the State of Virginia all heirs and legal representatives of the said Rudolph 
Spangler deceased Send Greeting. Whereas the Commonwealth of Pennsylvania by 
Patent or grant under the great seal dated the 16th day of April April A. D . 1806 for
the consideration therein mentioned did grant & confirm unto John Michael and 
to his heirs and assigns a certain tract of land Situate in the County of Mercer in
the State of Pennsylvania N'o 929 called Recompense situate in district No 5 Begin-
ning at a dogwood , thence by lot No 934 North two and a half degrees west two
hundred and Sixty one perches to a dogwood thence by lot No 928 North eighty 
seven degrees and a half east one hundred and thirty perches to a white oak 
thence by lot N' o919 & No 88 of 250 A[cres] South two degrees and a half east two hun- 
dred and Sixty one perches to a maple and thence by lot No 930 South 
eighty seven degrees and a half west one hundred and thirty perches to the 
Beginning containing two hundred acres and allowance of six per

cent &c with the appurtenances. To hold to him his heirs and assigns forever as in and 
by the said Patent Recorded in the land office in Patent Book No 56 page 359 &c may
appear and whereas the said John Michael by his Indenture of bargain and Sale for the
consideration money therein mentioned dated the 12th day of May AD 1806 did sell 
convey and confirm the same unto the within named Rudolph Spangler and to his 
heirs and assigns forever as in and by the said Indenture to be Recorded may more 
fully appear. Now Know ye that the said heirs and legal representatives of the said 
Rudolph Spangler dec'd for and in consideration of one dollar to them in hand paid 
by Daniel Spangler at and before the ensealing and delivery hereof the receipt 
whereof they do hereby acknowledge and thereof acquit and forever discharge the 
said Daniel Spangler his heirs executors and administrators by these presents 
have and each and every of them hath released remised and forever quit claim 
and by these presents do and each and every of them doth remise release and for-
ever quit claim unto the said Daniel Spangler and to his heirs and assigns 
all the estate and estates shares purparts and dividends rights liberties interest
whatsoever of them the said heirs of the said Rudolph Spangler dec'd in law 
or equity or otherwise howsoever of in and to all that tract of land above des-
cribed containing two hundred acres & allowance more or less Together with all
and singular the rights members and improvements whatsoever thereunto belong-
ing. Witness our hands and Seals the twenty second day of April one thousand 
eight hundred and twenty eight N. B the above written release was given and 
Executed on condition that if the above named Daniel Spangler does not move 
on the above described land and enjoy or occupy the same himself within two 
years from this date that then the above release of fall become void to all intents 
and purposes and the rights thereof shall revert back to the heirs of the said 
Rudolph Spangler deceased in the same manner as if this instrument of 
writing had never been made dated the day and year aforesaid sealed and

Spangler Elizabeth Nes Widow Geo Barnitz Charles Fisher and Helena his wife 
and acknowledged the foregoing release to be their and each of their acts and
deeds and desired the same to be recorded as such according to law. The said Femi-
nises and FemiCoverts above named being of lawful age and Separately by me
examinid declared upon such examination that they and each of them volunta-
rily and of their own free will & accord signed sealed & delivered the foregoing re-
lease as their acts and deeds and desired the same to be recorded as due to and that
they all know the contents thereof witness my hand and seal the twenty second 
day of April one thousand eight hundred and twenty eight

deed of release appears to have been acknowledged and whose signature is

said act a Justice of the peace in and for said County duly commissioned & sworn

faith and credit is due his official Given under my hand and seal of office at York

Virginia Corporation of Winchester ss . Before me the Subscriber one of the Justices of the peace 
in and for the said corporation of Winchester personally came Joseph Slagle & Margaret his 
wife and acknowledged the foregoing release to be their and each of their act and deed 
and desired the same to be recorded as such according to law the said Margant Slagle
being of lawful age and by me examined seperately and apart from her husband
declared upon such separate examination that she did voluntarily and of her 
own free will and accord sign seal and deliver the foregoing release , as her act and 
deed and desired the same to be recorded as such and that she knew the contents
thereof. Witness my hand and seal the second day of May one thousand eight hun-

Virginia Corporation of Winchester ss . I Lemuel Bent Clerk of the Court of the Corpora-
                         tion aforesaid do hereby certify that John W. Miller esquire before whom the 
{Winchester  } within deed of release appears to have been acknowledged by Joseph Slagle and
{ Corporation } Margaret his wife and whose signature is to the above certificate of acknow
{   Seal          } ledgement written was at the time of doing the same a Justice of the peace in 
and for said corporation duly elected and Sworn and that due faith and credit is and 
ought to be given to his official acts as well in courts of Justice as elsewhere given 
under my hand and the Seal of the said Corporation the 3'd day of May 1828.

The land in question is Donation Lot No. 929 in Mercer County, Pennsylvania, which was initially granted to John Michael for his Revolutionary War service in 1806.  Rudolph Spangler (1738-1811) of York County, Pennsylvania apparently bought the 200 acres from John Michael prior to 1811.   The heirs of Rudolph Spangler were his widow Dorothea Spangler, and their children Jacob Spangler, Jesse Spangler, George Barnitz (husband of Catharine Spangler), Elizabeth Nes, Charles E. Fisher (husband of Helena Spangler), and Margaret Slagle (wife of Joseph Slagle). 

Note that Daniel Spangler had to claim this land from the heirs within two years of this deed, and apparentrly did so.

Daniel Spangler (1781-1851) was born in York, Pennsylvania, the son of Rudolph and Maria Dorothea (Dinkel) Spangler.  He married Elizabeth King (1796-1863) on 12 March 1815 in York.  Daniel Spangler moved to Winchester, Virginia in about 1816, and then moved to this land in Mercer County in 1828.  

Daniel and Elizabeth (King) Spangler are my 3rd great-grandparents, through their daughter Rebecca Spangler (1832-1901) who married David Jackson Carringer (1828-1902) in 1851 in Mercer County, Pennsylvania.  The Henry Carringer and Daniel Spangler families were relatively close neighbors in the 1830-1860 time frame.
