Treasure Chest Tuesday -- 1828-1830 Receipts from Martha (Soule) Kirby's Heirs

Yes, I know it's supposed to be Treasure Chest Thursday, but I can't help it - I want to share some of the goodies that Susanne shared with me - see A Kirby Family Genealogical Windfall From Susanne (17 March 2016).

Today's treasures are the 1828 receipts from the heirs to the estate of Martha (Sowle) Kirby (1743-1828):

There are seven scraps of paper, and all are similar.  The transcriptions are:

The source citation for these papers is:

Ichabod Kirby Family Papers (loose papers on scrapbook page, created after 1801 by unknown persons), digital images of loose papers privately held by Susanne Nisbet, [address for private use], Wake Forest, N.C., 2016 (7th great-grandchild of Ichabod Kirby); Receipts of heirs to Martha Kirby's estate, 1828-1830. Provenance is David Kirby family of Westport, Mass. ca 1801 to Susanne Nisbet 2016, provided to Randy Seaver March 2016 via email.

The seven receipts are from:

*  Sibel Kirby, the daughter of David and Martha (Soule) Kirby, and brother of Ichabod Kirby, the son of David and Martha (Soule) Kirby, the executor of Martha Kirby's estate.

*  Benjamin White, the son of Humphrey and Sibel (Kirby) White, and the grandson of David and Martha (Soule) Kirby.

*  David White, the son of Humphrey and Sibel (Kirby) White, and the grandson of David and Martha (Soule) Kirby.

*  Jonathan White, the son of Humphrey and Sibel (Kirby) White, and the grandson of David and Martha (Soule) Kirby.

*  Meribah (White) Hutchinson, the daughter of Humphrey and Sibel (Kirby) White, and the granddaughter of David and Martha (Soule) Kirby.

*  Elizabeth (White) Wood and her husband, Peleg Wood, the daughter and son-in-law of Humphrey and Sibel (Kirby) White, and the granddaughter of David and Martha (Soule) Kirby.

*  Nancy (White) Cutter, the daughter of Humphrey and Sibel (Kirby) White, and the granddaughter of David and Martha (Soule) Kirby.

Apparently, the will of Martha (Soule) Kirby (1743-1828) gave personal property to her daughter, Sibel (Kirby) White, and gave $70 to each of her named White grandchildren, children of Humphrey and Sibel (Kirby) White.  There were several other children of Humphrey and Sibel (Kirby) White alive in 1828, but there are no receipts for them; perhaps they did not return the receipt to the executor, or perhaps they were not specifically named by Martha (Soule) Kirby in her will for some reason.  Ichabod Kirby, the executor of this estate, and the son of David and Martha (Soule) Kirby, was not married in 1828 and had no children.  

I have looked several times in the Bristol County, Massachusetts Probate Court records available in the Massachusetts, Wills and Probate Records, 1635-1991 database on Ancestry.com without finding the probate records for Martha (Soule) Kirby.  I used the index with her name and did not find a match.  I browsed the probate packet list, and the microfilm images for the Kirby estate packets, and browsed the probate court clerk record books for the Martha Kirby estate, and have not found a will or any other estate papers, let alone the receipts provided above from Susanne's collection.  

Why is there no probate record for Martha (Soule) Kirby in the Bristol County Probate Records?  I have no clue!  But, apparently, there was a will because there are these receipts from her heirs.  It is possible that the executor, Ichabod Kirby, did not file the papers with the probate court.  

Martha Kirby's husband, David Kirby (1740-1832) was still alive when Martha died in 1828, and had his own probate records - see Amanuensis Monday - Post 313: 1822 Will of David Kirby (1740-1832) in Bristol County, Mass.  I looked in his probate packet papers, and did not see reference to Martha's will or the receipts.

Since Martha bequeathed specific items to her daughter and grandchildren, it is likely that she received this personal property from her father's estate, as indicated in the 1822 will of David Kirby.  I have not yet transcribed the will of Benjamin Soule (1719-1803).

Martha (Soule) Kirby (1743-1828) is my 5th great-grandmother, through her daughter Sibel (Kirby) White (1764-1848).
