Amanuensis Monday -- 1821 Deed of David Kirby to Humphry Kirby for Land in Westport, Bristol County, Massachusetts

This week's document for transcription is the 1821 Deed of David Kirby of Westport. Massachusetts selling 13 acres of land to Humphry Kirby in Westport, Bristol County, Massachusetts for $380.

Know all Men by these Presents , That I David Kirby of Westport in

the County of Bristol and Commonwealth of Massachusetts, Yeoman,

in consideration of three hundred and eighty dollars paid by

Humphry Kirby of the Town County and Commonwealth aforesaid,

yeoman, the receipt whereof do hereby acknowledge do hereby

give, grant, sell, and convey unto the said Humphry Kirby and to

his heirs and assigns forever A certain tract or parcel of upland

and Salt meadow adjoining, situate in Westport aforesaid on the

east side of Accoxet River, containing by Estimation thirteen acres

be the same more or less, and is bounded Easterly partly on the

Grantees land and partly of a Creek, Southerly on said creek

Westerly partly on Justice Kirbys land, and partly on the River, and

Northerly on the River with all the previleges and appurtenan-

ces to the same belonging. To Have And To Hold the afore granted

premises to the said Humphry Kirby to his heirs and assigns,

to his and their use and behoof forever. And the said David

Kirby for myself my heirs Executors and Administrators do cov-

enant with the said Humphry Kirby and his heirs and assigns,

That I am lawfully seized in fee of the afore granted premises:

That they are free of all incumbrances; That I have good right to

sell and convey the same to the said Humphry Kirby as afores'd

And that I will warrant and defend the same premises to the

said Humphry Kirby and to his heirs and assigns forever against

the lawful claims and demands of all persons. In Witness

whereof I the said David Kirby together with my wife Martha

Kirby who hereby voluntarily relinquishes her right of dower in

the aforegranted premises have hereunto set our hands and

seals this twenty seventh day of March in the year of our Lord

One thousand eight hundred and twenty one.

By this record it appears that David Kirby sold 13 acres of land in Westport to Humphry Kirby for $380. The dower on the land was released by Martha Kirby. The parcel was bounded by lands of David Kirby, Justice Kirby a creek and the Accoxet River. Humphry Kirby may be a nephew of David Kirby.

David Kirby (1740-1832) married Martha Sowle (1743-1828) in 1763 and they had two children. They are my 5th great-grandparents through their daughter Sibel Kirby (1764-1848) who married Humphrey White (1757-1814) in 1786.

Know all Men by these Presents That We David Kirby & Martha Kirby

both of Westport in the County of Bristol & Commonwealth of Massachusetts

being Husband & wife in consideration of Fourteen Hundred Dollars

paid by Benjamin Devol of the Town & County afores'd Yeoman the Re-

ceipt whereof we do hereby acknowledge, do hereby give grant sell & convey

unto the said Benjamin Devol, a certain undivided half of a Farm

situate in Westport afores'd containing about eighty acres in the

whole of the Farm be the same more or less & is all that farm which

Benjamin Sowle late of Westport dec'd bought of the Heirs of Joshua

Richmond dec'd which s'd Benjamin Sowle who was the father of the s'd

Martha Kirby did in his last Will & Testament give unto her the one

half of s'd Farm with all the Buildings & priviledges thereto belonging;

unto her & her Heirs & Assigns forever: which s'd Farm is bounded Northerly

partly on Land belonging to Sylvester Brownell & partly on land belonging

to Joseph Brownell, Westerly on Land belonging to the s'd Sylvester & Joseph

& Southerly partly on the s'd Sylvesters Land & partly on the Grantors land

& Easterly partly on a pond & partly on the s'd Sylvesters land, which s'd

undivided half with all the Buildings & priviledges thereto belonging,

that is all the Right, title & Interest which we have to s'd Farm we do here-

by sell & convey. To Have and To Hold the afore granted premises

to the s'd Benjamin Devol his Heirs and Assigns to his & their Use

& Behoof forever. And we do covenant with the s'd Benjamin Devol his Heirs

& Assigns, that we are lawfully seized in fee of the aforegranted Premises;

That they are free of all Incumbrances; That we have good Right to sell

& convey the same to the s'd Benjamin Devol And that we will warrat

all y'e right & Title & Claim that I have, I myself my heirs & assigns forever,

to a certain peice of salt meadow Sedge flat, that was my father Ichabod Kirby

late of Westport Dec'd lying in ye Eastermost Branch of Coaset River so called,

& known by ye name Lonnon flat, Bounded as followeth Southerly on

Wesson Kirbys, & partly on ye Creek, Westerly on meadow belonging to Robert

Brownells heirs , & Northerly on Preserved Tripps, Easterly on Stephen

Cornells, the above discribed Sedge flat I give up all of right Title, that

I myself my heirs & assigns have, unto my Brother John Kirby of Westport

in ye State afores'd to him y'e sd John Kirby & to his heirs & assigns forever, to

Know all Men by these presents, that I Ichabod Wilbore of Easton in ye

State of New York yeoman, the receipt whereof I do acknowledge, have remised

released & forever quit Claimed, & by these presents do absolutly remise release

& forever Quit Claim unto David Kirby of Westport as afores'd & to his heirs &

assigns forever, all my right & Title in Saltmarsh given to me by my Grand-

father Ichabod Kirby in his last Will & Testament. In consideration of ye

said David Kirby paying to me thirteen pounds, thirteen Shillings of good

& lawfull money and S'd Marsh is Bounded as follows. Northerly on Marsh

belonging to Robert Kirby, Easterly & Southerly on Pasquanasket Creek,

& Westerly on marsh belonging to David Kirby, unto him the said

David Kirby and to his heirs & assigns forever, so that neither of the said

Ichabod Wilbore nor my heirs nor any other person for or under me, in

my right or stead hereafter shall have, claim or demand any right Ti-

tle, Intrest or property in or to the same or any part thereof but Shall

forever hereafter be utterly excluded and debarred by these presents. In

The parcel was bounded by lands of Robert Kirby, the creek, and David Kirby. The deed was executed 7 February 1794 and recorded 21 April 1795.

Rebecca Potter was born in about 1681 in Dartmouth, Massachusetts, the daughter of Nathaniel and Elizabeth (Stokes) Potter[1-3].

She married Robert Kirby (1674-1757), the son of Richard and Patience (Gifford) Kirby, in about 1700 in Dartmouth[7], and they had 7 children:

* Patience Kirby (1700-1740), married 1722 John Lawton (1692-1753).

* Ichabod Kirby (1705-1793), married 1733 Rachel Allen (1708-1801).

* Nathaniel Kirby (1708-1748), married 1731 Abigail Russell (1712-1785).

Rebecca's father, Nathaniel Potter, died testate, having written his will on 18 October 1704, and it was proved on 20 November 1704[4]. In his will, Nathaniel gave his daughter Rebekah Kirby:

"...Allso I give to my Daughter Rebeckah Kerby the sum of two pounds or a cow."

Rebecca's husband, Robert Kirby, died testate, having written a will on 26 March 1755, which was proved in Bristol County Probate Court on 10 March 1757[5]. In his will, he provided for his wife, Rebeckah:

"Imprimus I give & bequeath to my Loving wife Rebeckah Kirby the use & Improvement of the best house where I Now live for & During the time she Remains my widow.

"Itim I give unto my sd Wife Rebeckah two of my best Cows & one Rideing beast & also the Keep^ing^ of the sd two Cows & Riding beast both winter & Sumer on my homestead farm yearly & Every year During the time She Remains my widow & no longer at Equal Charge of my two Sons (viz) Silas Kirby & robert Kirby I also give unto my sd wife Rebeckah two hundred weight of good beaf & one hundred weight of Good Pork & twenty bushels of good Indian corn to be provided & Delivered unto her by my two Sons Namely Silas Kirby & Robert Kirby at Equal Charges It is to be understood So much of each sort yearly & Every year During the time she Remains my widow & No longer I also give unto her my sd wife Rebeckah Kirby the one half of all my houshold goods & a priviledge to Keep what souls she hath a mind to Keep on my sd homestead farm I also give unto her my sd wife Rebeckah Kirby the Sum of Eight pounds & ten shillings in Lawfull money of the province aforesaid I also give unto her my sd wife fire wood sufficient for her use Cut to a suitable Length & brought to the in manner following: four Cords thereof to be provided by my two sons (viz) Ichabod Kirby & Recompence Kirby at Equal Charges it is to be understood four Cords of wood yearly & Every year During the time She Remains my widow & all the Rest of the wood that She Shall have ocation of for her use to be provided & Delivered unto her by my two sons Namely Silas Kirby& Robart Kirby at Equal Charges."

Rebecca Kirby died testate on 10 October 1773 in Dartmouth. Her will was written on 1 July 1763, and proved in Bristol County Probate Court on 21 December 1773[6]. The transcription of the will of Rebecca (Potter) Kirby is:

"This first day of July Anno Domini one thousand seven hundred and Sixty three I Rebekah Kerby of Dartmouth in the County of Bristol & province of the massachusetts Bay & a Widow and Relict of Robert Kerby late of Dartmouth deceased being weak in body but of a sound Disposing mind & memory and calling to mind the mortality of my body and Knowing that it is appointed for all men & women to die do make & ordain this my last will and testament that is to say principally and first of all I commit my body to the earth to be decently buried ??? the expense & discretion of my executor herein after named. And as touching my worldly Estate with which it has pleased God to bless me in this life I do give demise & dispose of it in the folling manner and form viz.

"Imprimis My will is that all my lawful & just debts and funeral charges be first paid & discharged by my Executor (herein after named) out of my Estate.

"Item I give and bequeath to my daughter Barsheba Kerby all and singular my whole Estate of what kind soever it be to be hers her heirs & assigns forever excepting what is above reserv'd for the paying my just debts & defraying my funeral charges.

"Item And whereas I have Other children and grandchildren besides the above named Barsheba Kerby yet the reason why I have not given Each of them something in this my last will is first because all of my said children & grandchildren have had bequests made them by my husband Robert Kerby late of Dartmouth deceased and secondly because my afforesaid daughter Barsheba being of a Weakly constitution will stand in greater need of what little I shall leave for her support during her life.

"Lastly I constitute ordain and appoint my well beloved son Ichabod Kerby sole executor of this my last will and testament and I do hereby utterly disallow, revoke and disanull, all and every other former testaments, wills, legacies, and bequests by me in any wise before named, willed and bequeathed, ratifying and confirming this & no other to be my last will & testament in witness whereof I have hereunto set my hand and seal the day & year first above written.

Then before the Hon'bl George Leonard Judge of probate of wills &c for the County of Bristol Came Adam gifford and Jeremiah Gifford two of the witnesses to the before written Instrument and made Oath that they were present & saw Rebeccah Kirby the subject ????? ????? did signe seal & heard her Publish & Declare sd Instrument as her Last will and Testament and that she was of a sound and disposing mind & memory when she ????? and they with Daniel Hathaway signed & wittnessed with them at the same time and all in the presence of the Testator.
