Amanuensis Monday -- 1703 Will of John Mainord (1630-1711) of Marlborough, Massachusetts

[torn] Will and Testiment of John Mainord Sen'r

[torn] In the name of God Amon.

[torn] John Mainord sen'r, Being sound in mind but weak in body, having

many Infirmities atending my weake body, but yet Retaining sound

in my judgment I doe therefore herin Leave my Last will and Testiment

as followeth.  First I do freely give & bequeath my soull to god that

gave it in the name of Jesus Christ, and my body to the dust from

where it was, and by my ???? which I leave behind me to be decently

buryed.  Item I will y't my just debts be first paid out of my

estat.  Item i doe ???? Confirm unto my four sons namely John

mainord Simon mainord David mainord & Zachariah mainord all which

[torn] heretofore given them by deed of Gift under my hand and ?????

[torn] ther Lawfull heiers forever, as ther portions in full, except

[torn] above Given in this my will.  As further i doe will & Give

unto my oldest Son John abovesd The uper end, or westerly part of my

medow called by the name of Richard medow, the wholl breadth therof until

it Come to the narowest place right cros from upland to upland, further I give

unto my s'd Son John a five acre town Right within the Cow Commons to

him & his heres for ever.  Item i doe will and Give unto my two daug-

hters namly hannah davenport and Elizabeth Brigham as the remainder

in mony prise, in cattell at the judgment of and apparent prisers, chosen by ????

party Concerned, to ?????? & deliver.  Likwise i will & Give unto my

daghter Elizabeth twentie Shillings in any Good marchantabell pay.  I doe

further will y't my daughter Hannah shall be first paid within the space

of twoo years after my deceas.            Furthermore I give

unto my youngest son Joseph mainord, all that part of my hom Lot

Lands and medows & Barne upon it, with the Stocke of Cattell y't shall

belong to me and my estat, and the severall medows.  Likwise I give to my

son joseph, namly that which i bought of Sam'll Stow Richard medow

the pod medow and the medow Called the acer at that Called the acer

brooke to him my son joseph and his lawfull heiers for ever.

only I die will and bequeath to my Loveing wife the east end of my

house with half the seler for her use and improvement whilst Shee rem-

ain my widdow.  Item I give to my too youngest Daghters namly

Sarah & Lydiah mainord each of them ten pounds apeice in Cattell

out of the stock of Cattell at mony prize to be paid out in three

years to both of them after my deceas - that is to say ten pounds apeice

with what Cr???? they call their own allredy.                Furthermore

I Will unto my Loveing Wife all my moveabell estat y't is within my

Dwelling house, for her own use and improvement, and to dispose

of as she shall see cause to my twoo youngest daughters for ever,

namly Sarah & Lidiah, further i will unto my Loveing wife 2 Cows

out of my Stocke for her own use and improvement & doo order

my son Joseph to keep them for her, winter and sumer, whilst shee remain

my widow, & if he see cause to kill either of them of, to make them Good

in another, y't shee be well maintained out of what i give to him in sections

and in health according to her ranke and quality, dureing her Life or rem-

aining my widdow.  Item - i will also y't if Rachell wheeler doe Li????t

my wife until shee be eighteen years old, then shee shall be Cloathed w'h doub-

all suit of aparell by my wife, and if she shall see Cause to farme out

my wife until shee be at 20 yers of age then she the s'd Rachell

shall have a heifer of 3 yers old out of the Stocke of Cattell.

I further doe will and give unto my son Simon ten shillings mony

I will also to my son Zachary - ten shillings mony each of them

to be paid within 4 years time after my deceas.

i will to David & Joseph equaly betwen them my wearing Cloaths

Item - doe further will & give to my son Joseph all my [torn]

uttinsels and tools of all sorts both wooden and iron, and also my

first Cedar Swamp ???, and a eighten acers town right within the Cow

Commons and my right in the meetting house.

I doo further will and order that my son Joseph Shall pay out all

the severall Legasies out of my moveabell estat given to him

to my severall Childre, in this will mentioned, and if ther should not

be enough found at my deceas for every one acording to my will, then

then what may be found they shall all share in proportioning acording

to ther sumes severaly given.  I doe give unto my twoo grand childs

namly may woods & Elizabeth woods six shillings apiece in mony to be paid

next after my own children are paid out of my moveabel estate Given

to Joseph my son, & finally I doe will and apoint ^Sarah^ my Loveing wife

and Joseph my youngest son to be my exetrix and executor of this

my Last will and testiment, and doe her order and appoint my son

Joseph to pay all the Legasies as herin given out of the moveabell estat

which I havee Left him, and further what Child or Chilldren of mine

shall make disturbance one with another about ^this^ my will contrary

to what is herin given, and not rest satissfied, i will y't that Child

or Children shall Loos his right, or her right herin Given, and be equ-

ally divided amongst the rest, and further I doe Constitue and

Request my Loveing friends John Woods sen'r and Isaac Amsden sen'r

to be my over seers to this my Last Will and testiment - as wittness

my hand and seale this eighteenth day of May one thousand seven

hundrid and three - and in the 2d year of her majestyes Reign Ann

John Mainord (1630-1711) married (1) Mary Gates (1636- ca 1676) on 5 April 1658 in Sudbury, Massachusetts.  They resided in Marlborough, and had seven  children:

*  Mary Maynard (1659-1689), married ???? Woods.

*  Hannah Maynard (1660-1729), married 1680 Jonathan Davenport (1658-1729).

*  John Maynard (1661-1731), married 1688 Lydia Ward (1665-1740).

*  Elizabeth Maynard (1664-1733), married 1692 Nathan Brigham (1672-1747).

*  Simon Maynard (1666-1748), married 1693 Hannah Newton (1671-1748)

*  David Maynard (1669-1757), married 1702 Hannah Waite (1670-1724).

*  Zachariah Maynard (1672-1738), married 1697 Mary Geer (1671-1739).

John Mainord married (2) Sarah (Blandford) Keyes (1643-1724), widow of Elias Keyes, in about 1679 and they had:

*  Sarah Maynard (1680-1757), married 1704 Joseph Johnson (1672-1727)

*  Lydia Maynard (1682-????), married 1713 Thomas Hagate (1675-????)

*  Joseph Maynard (1685-1721), married 1707 Elizabeth Price (1687-1775).

John Mainord died testate on 22 December 1711 in Marlborough, having written a will on 18 May 1703, and added codicils to his will in 1708 and 1709.  All were proved on 8 January 1711/12 in Middlesex County Probate Court, by executrix widow Sarah Mainord and executor son Joseph Mainord.  There is an inventory but no account in this probate estate packet.  The codicils and the inventory are very difficult to read, as was this will in parts due to the torn edges and the handwriting.

John and Mary (Gates) Mainord are my 8th great-grandparents, through their son John Maynard (1661-1731) who married Lydia Ward (1665-1740) in about 1688, and also through their daughter Elizabeth Maynard (1664-1733) who married Nathan Brigham (1671-1742) in about 1692 in Marlborough.
