Amanuensis Monday -- 1866 Guardianship Record of Alvin L. Seaver of Tewksbury, Massachusetts

To the Honorable the Judge of the Probate Court in and for the County of Middlesex:

Respectfully represents  Martha L. Seaver
of  Tewksbury  in the County of  Middlesex
that there is occasion for the appointment of a Guardian of  Alvin L. Seaver
a minor, aged fifteen years, having been born
June 25th A.D. 1851 in said Tewksbury and

of Tewksbury aforesaid, in the County of Middlesex, minor and child
of Daniel Seaver, deceased  late of  Tewksbury
in the County of  Middlesex  and Martha L. Seaver
his widow, & your petitioner.

and your petitioner prays that She may be
appointed to that trust.

Dated this  fourth  day of  September  A.D. 1866

Middlesex, ss.  September 3d, A.D. 1866  Personally appeared the above-
named   Alvin L. Seaver
minor, above the age of fourteen years, and nominated said  Martha L. Seaver,

assent to the granting of the foregoing petition.

At a Probate Court holden at  Lowell  in and for said County of
Middlesex, on the  fourth  day of  September
in the year of our Lord one thousand eight hundred and sixty  Six.

The petition of  Martha L. Seaver
praying for the appointment of a Guardian of
     Alvin L. Seaver

of Tewksbury, in the County of Middlesex, minor, having been
considered, and it appearing that said Alvin L., is
above the age of fourteen years & has made
choice of said petitioner and that
the surviving parent, his mother,  has assented thereto,

It is Decreed that said petitioner
be appointed Guardian of the person and estate of said minor, first giving bond, with sufficient sureties,
for the due performance of said trust.

Alvin Lafayette Seaver (1851-????) was born 25 June 1851 in Tewksbury, Massachusetts, the third son and youngest child of Daniel Seaver and Martha L. Ticknor.  There is no marriage record or death record in Massachusetts vital records for him.  

Daniel Seaver (1814-1866) of Tewksbury died intestate before 4 September 1866.  His widow was named administrator for his estate and petitioned for guardianship of Alvin L. Seaver in the above papers.  However, there are several more papers in the Probate File 41,269 in Middlesex County Probate Court, including:

*  4 September 1866:  A Guardian's Bond of $2000 was posted with sureties of Martha L. Seaver, David Ticknor, Jr. and Elbridge Dearborn.

*  1 October 1866:  A Guardian's petition and license to sell real estate for maintenance purposes.  The real estate was the whole 40 acres of land in the southwest portion of Tewksbury that was the property of Daniel Seaver.  The petition stated that Alvin's portion of the land could not be sold without injury to the whole.  The next of kin (his Martha L. Seaver and her son George A. Seaver) assented to the sale.

*  2 October 1866:  The probate judge approved the petition.

*  2 October 1866:  A Guardian's bond of $100 was posted by Martha L. Seaver, Elbridge Dearborn and David Ticknor, Jr.

*  13 November 1866:  An affidavit of sale of real estate for maintenance was filed by Martha L. Seaver, including the notice of intent to sale published on 19 October in the Lowell newspaper.  The Justice of the Peace approved the petition.

*  16 December 1866:  Three appraisers were appointed to apprise the estate and effects of Alvin L. Seaver by the Probate judge.  

*  22 January 1867:  A Guardian's Order for inventory, return and schedules was filed by Martha L. Seaver.  The estate was appraised at $400 and the Guardian charged $32.80 for expenses and charges.

Alvin Lafayette Seaver was my 6th cousin 4 times removed, with our common Seaver ancestor being Robert Seaver (1608-1683) of Roxbury, Massachusetts.
