Amanuensis Monday -- 1868 Will and 1870 and 1871 Codicils of Sarah C. Seaver in Chester County, Pennsylvania

  This week's document for transcription is the 1868 will and 1871 and 1872 codicils of Sarah C. Seaver (1787-1872), in the Chester County, Pennsylvania Probate Court records.

Will of                 |   I, Sarah C. Seaver, formerly of Marlboro, Middlesex County, Massachusetts, now of
Sarah C. Seaver |   Reeseville, Chester County, Pennsylvania, Widow of Herman Seaver, being of sound
---------------------  disposing mind and memory, hereby revoking all other former wills by me
at any time made, do make and publish this as my last will and Testament, in
words following, that is to say.  1.  Item.  I direct all my just debts and funeral expenses to be paid
and discharged as soon after my decease as reasonably may be.  2.  Item.  I give and bequeath
my watch to my son William R. Seaver.  3. Item. I give and bequeath all my furniture and
wearing apparel, and silver ware to my three daughters, Elizabeth W. wife of Rev. John McLeod of
Philadelphia, Sarah R. wife of Horace Day of New Haven, Connecticut, and Hannah P., wife of Wilson
Homer of Hubbardstown,  Michigan, to be equally divided between them as they may select, and in
case of any difference or disagreement between them as to such division, the same shall be made by
my Executors hereinafter named whose decision shall be final and binding.  4. Item. I give devise
and bequeath one equal fourth part of all the rest, residue and remainder of my estate, real, personal
and mixed whatsoever and wheresoever, to my said daughter Elizabeth the wife of Rev. John McLeod,
absolutely.  5.  Item.  I give, devise and bequeath one other equal fourth part of all the said rest,
residue and reminder of my estate real, personal and mixed, whatsoever and wheresoever to my said
daughter, Sarah R. wife of Horace Day, absolutely.  6. Item.  I give, devise and bequeath one
other equal fourth part of all the said rest, residue and remainder of my estate real, personal
and mixed whatsoever and wheresoever, to my said daughter Hannah P., wife of Wilson Homer,
absolutely.  7.  Item.  And as to the remaining one equal fourth part of all said rest, residue and
remainder of my estate real, personal and mixed, whatsoever and wheresoever, I give devise and be-
queath the same to my son-in-law the said Wilson Homer of Hubbardstown, Michigan, in trust
nevertheless, for the use and benefit of Ellen and Mary Susan the two youngest children of my
said son William R. Seaver of Hubbardstown, Michigan and of any other children he may here-
after have, the principal of said one fourth together with the interest income and dividends
thereof to be applied by my said Trustee at his discretion for the support, maintenance and educa-
tion of said children during their minority, and whatever of said one fourth either principal or in-
terest shall so may remain and be unexpended at the time when the youngest surviving of said chil-
dren shall have attained the age of twenty one years my said Trustee is to pay over and I hereby
give devise and bequeath whatever so may remain of the said one fourth to my said son William
R. Seaver absolutely.  8.  Item.  I nominate and appoint my son-in-law the said Rev John McLeod
and Wilson Homer, and the survivor of them, Executors of this my last will nd Testament, and
inasmuch as said Wilson Homer is a now-resident of the State of Pennsylvania, I direct that no securi-
ty be required of him.  In witness whereof I have hereunto set my hand and seal this second day
of March Anno Domini one thousand eight hundred and sixty eight.

and Testament in our presence, who in her presence and at her request and in the presence of each
other have hereunto subscribed our names as witnesses.

Codicil.  Whereas I have appointed my son-in-law the said Rev. John McLeod one of the Executors
of this my last will and Testament I hereby revoke the above said appointment and appoint
in his place and stead my son-in-law Horace Day of New Haven, Connecticut, and inasmuch
as said Horace Day is a non-resident of the state of Pennsylvania I direct that no security be required
of him.  In witness whereof I have hereunto set my hand and seal this sixteenth day of
March Anno Domini One thousand Eight hundred and seventy.

above her last will and Testament in our presence, who in her presence and at her request, and in the

Codicil Second.
The seventh Item in the above will I revoke entirely and in place thereof
I give devise and bequeath the remaining one equal fourth part of all the said rest residue and
remainder of my estate real personal and mixed whatsoever and wheresoever to my daughter-in-law
Mrs. Mehitable Seaver wife of my son William R. Seaver absolutely.  In witness whereof I have
hereunto set my hand and seal this Fifth day of August Anno Domini one thousand eight
hundred and seventy one.

med sign seal publish pronounce and declare the same as and for her last will and Testament and at the time of so
doing she was of sound and well disposing mind and memory, to the best of their knowledge and belief.
                                                                    Affirmed before me.   Seymour Cauley, Register.

Be it Remembered That on the 17th day of Sept. A.D. 1872, the last Will and Testament, and two Codicils thereto of Sarah C. Seaver  late of
Easttown dec'd, was proved in due form of law and Letters Testamentary thereon were duly granted to Wilson Homer Seaver and Horace Day
affirming who were sworn and affirmed well and truly to administer the goods and chattels, rights and credits of said dec'd, according to law;
also diligently and faithfully regard, and well and truly comply with the provisions of the law relating to Collateral Inheritances.

Sarah Cazneau Rice (1787-1872) was born 25 November 1787 in Marlborough, Massachusetts, the daughter of Noah and Hannah (Palfrey) Rice.  She married Heman Seaver (1769-1835) on 12 February 1816 in Marlborough, Massachusetts as his second wife.  Heman Seaver was the son of Norman and Sarah (Read) Seaver of Shrwsbury and Westminster, Massachusetts.  Heman and Sarah C. (Rice) Seaver had five children:

*  Aaron Weeks Seaver (1819-1819).
*  Rev. William Rufus Seaver (1822-1898), married 1842 Mehitable Homer (1822-1908).
*  Elizabeth Weeks Seaver (1824-1882), married (1) 1844 Norman Seaver Frost (1816-1854); (2) 1856 Rev. John McLeod (1817-1901).
*  Sarah Rice Seaver (1825-1898), married 1844 Horace Day (1816-1902).
*  Hannah Palfrey Seaver (1827-1882), married 1846 Wilson Hamilton Homer (1812-1890).

It is Primary Information and Direct Evidence of the names, relationships, dates and places noted therein.

There may be other records for this probate file, perhaps an inventory, account and distribution in Chester C County Probate Court records. 

I am a 1st cousin 5 times removed to the children of Sarah Cazneau (Rice) Seaver, with the common Seaver ancestor being my 5th great-grandfather Norman Seaver (1734-1787).
