Amy Johnson Crow suggested a weekly blog theme of "52 Ancestors" in her blog post Challenge:  52 Ancestors in 52 Weeks on the No Story Too Small blog.  I am extending this theme in 2016 to 156 Ancestors in 156 Weeks. Here is my ancestor biography for week #133:

David Kirby (1740-1832) is #178 on my Ahnentafel list, my 5th great-grandfaother, who married #179 Martha Soule (1743-1828) in 1763.

The biography and family information for David Kirby was summarized in the book The Kirbys of New England by Melatiah Everett Dwight, published in 1898[1].

David Kirby was the third child and second son of Ichabod and Rachel (Allen) Kirby of Dartmouth, Massachusetts.  The Dartmouth town record book records his birth as[3]:

"David Kerby the son of Ichabod Kerby
and Rachell his wife was born the sixteenth day of the
month called August 1740."

The intentions of marriage of David Kerby and Martha Sowle was recorded in the Dartmouth, Massachusetts town record book for births, marriages and deaths (and the published town vital records book) as[19]:

"Kerby, David and Martha Sowle, both of Dartmouth, Mch 19, 1763"

The marriage of David Kirby and Martha Sowle was also recorded in the Rhode Island town records for Tiverton, and was summarized in the Rhode Island Vital Records by Arnold[4].  The entry says:

"KIRBY, David, and Martha Sowle, both of Dartmouth; m. by Restcome Sanford, Justice, April 21, 1763."

Only two children were recorded in Dartmouth, Massachusetts town records - Sibel Kirby (in 1764) and Ichabod Kirby (in 1782).  There may have been other children who died in infancy or young adulthood for whom there are no records.

David Kirby was a Revolutionary War soldier.  The entry in the Massachusetts Soldiers and Sailors book for David Kirby says[6]:

"Kirby, David, Dartmouth.  Private, Capt. Luen Pope's co. of militia, which marched April 21, 1775, in response to the alarm of April 19, 1775, to Roxbury; service 5 days;  also, Capt. Daniel Egery's co., Col. Timothy Danielson's regt.; muster roll dated Aug. 1, 1775; enlisted May 6, 1775; service 3 mo's, 2 days; also, order for bounty coat or its equivalent in money dated Roxbury, dated Dec. 24, 1775."

The Massachusetts Soldiers and Sailors book also indicates that[15]:

"Kerby, David, Dartmouth.  Private, Capt. Daniel Egrey's (Egerys) co., Col. Timothy Danielson's regt.; company return dated Camp at Roxbury, Oct. 6, 1775" 

On 21 Mat 1777, David Kirby paid the town of Dartmouth, Massachusetts for being drafted.  The record says[7]:

"Dartmouth may the 21 Day AD 1777
Received of David Kirby ten pounds
Lawfull money for his being Draufted
a Continental Soldier for Nine months
Received by me one of the Committy of
Safty
                                     Benj'a Brownell"

In the 1790 United States Census, the David Kurbee household was enumerated in Westport, Bristol County, Massachusetts[16].  The household included:

*  1 male over age 16 (certainly David Kirby)
*  1 male under age 16 (probably son Ichabod Kirby)
*  2 females (certainly wife Martha Kirby and one other female)

David Kirby was the executor of his father's (Ichabod Kirby's) estate in 1793[8].  He was bequeathed a feather bed with furniture, some tools, half of the wearing apparel and half of his notes for money.  David was given the homestead farm in Dartmouth and all other real and personal estate not otherwise disposed of.

David Kirby was also directed by his father to provide his mother sheep's wool, flax, Rye, molasses, beef, four silver dollars, firewood, milk from the cow, , butter, cheese, cyder, and apples every year she remained his widow.  

He  built an addition to the old house on the north side, against the old stone chimney[1].

In the 1800 United States census, the David Kerby household was enumerated in Westport, Bristol County, Massachusetts[17].  The household included:

*  1 male aged 16 to 26 (probably son Ichabod Kirby)
*  1 male over age 45 (certainly David Kirby)
*  1 female aged 26 to 45 
*  1 female over age 45 (certainly wife Martha Kirby)

On 5 April 1803, David Kirby's livestock earmark was registered in the Westport, Massachusetts town record book[9].  The registration notes:

"David Kirby's Ear Mark for his Creatures is a half
penny before & behind the left Ear
Recorded April the 5th 1803, By William Almy, Town Clerk."

In the 1810 United States Census, the David Curbee household was enumerated in Westport, Bristol County, Massachusetts[18].  The household included:

*  1 male aged 26 to 45 (probably son Ichabod Kirby)
*  1 male aged over 45 (certainly David Kirby)
*  1 female aged 10 to 16
*  1 female aged 16 to 26 
*  1 female aged over 45 (certainly wife Martha Kirby)

In the 1820 United States Census, the David Kirby household was enumerated in Westport, Bristol County, Massachusetts[10].  The household included:

*   1 male aged 16 to 26 (an unknown male)
*  1 male aged 26 to 45 (probably son Ichabod Kirby)
*  1 male aged over 45 (certainly David Kirby)
*  1 female aged 16 to 26 (an unknown female)
*  2 females aged over 45 (certainly wife Martha Kirby and an unknown female)

In the 1830 United States Census, the David Kirby household was enumerated in Westport, Bristol County, Massachusetts[11].  The household included:

*  1 male aged 40 to 50 (probably son Ichabod Kirby)
*  1 male aged 81 to 90 (certainly David Kirby)
*  1 female aged 61 to 70 (an unknown female)

The death date of David Kirby was not included in the Westport, or Dartmouth, Massachusetts vital records;  it was found in the papers from the Ichabod Kirby estate provided by Susanne Nisbet[12].  The heading of the paper says:

"A memorandum of the births and deaths of Ichabod and Rachel Kirby
And births of their Children"
The death information included:

"Martha Kirby Deceased may 27th 1828
David Kirby Deceased February 10th 1832."

David Kirby died testate, having written a will dated 22 March 1822. The will reads (transcribed by the author from the unnumbered Estate packet in Bristol County (Massachusetts) Probate Records [13]:

"The last Will and Testament of David Kirby of Westport in the County of Bristol and Commonwealth of Massachusetts, Yeoman.

"Imprimis - my will is that all my just debts, funeral charges, and expenses of settling my estate be paid by my executor herein after named out of what I shall herein give him.

"2d.  I give to my beloved wife Martha Kirby all my household goods of every sort and kind except what I shall herein other wise dispose of together with my side saddle.  I also give her my said wife, all the Estate that come to us, out of the Estate of her honoured Father Benjamin Sowle, that we are possessed of, or that we may be possessed of at my desease, be it money, securities for, money, or of what sort or kinds of goods or property, it may consist of, all the aforesaid a free gift at her own disposal, forever.  I also give to my said wife so long as she remains my widow the use and improvement of one half of my now dwelling House, with a privilege in the cellar, to the well, and around the House as she may need.  I also give her to be provided by my Executor herein after named, and delivered to her daily, and every day, during the term aforesaid, the milk of one good cow; and yearly, and every year, one hundred pounds of good pork, eighty pounds of good beef, two geese, nine bushels of good Indian Corn, two bushels of rye or barley, ten pounds of good sheep wool, eight pounds of ???? flax from the Swingles, forty pounds of good cheese, eight pounds of good butter, four gallons of molasses, eight bushels winter apples and summer apples and summer & winter sauce as much as she may need for her own use.  And as much fire wood as she may need for one fire at the door, and cut a suitable length for her fire, and two hens to be kept for her so long as she may need.  All the aforesaid gifts to my said wife to be in lieu of her right of dower in my estate, if she is pleased to accept, and not otherwise.

3d.  I give to my daughter Sibbel White, Two hundred silver dollars to be paid her in one year after my decease, by my executor herein after named, which with what she has already had of me, is to be her share of my estate.

4th.  I give to my son Ichabod Kirby and to his heirs and assigns forever, my clock, and desk, one large silver spoon, two feather beds, bedsteads & ends, with a sufficiency of furniture for the same both for winter and summer, my loom and tackling belonging to it, my largest brass kettle, trammels and handirons, one large iron kettle, & one six Qt. kettle, my cupboards, and one meat tub & one meat Barrel, a chest with one draw, and a small chest, one case knives & forks, and half a doz. chairs, together with my homestead farm, and all the rest and residue of my estate both real and personal wherever and whenever it may be found, not herein otherwise disposed of, he doing and performing what I have herein ordered for him to do and perform.

"Finally and lastly, I do hereby constitute and appoint my son Ichabod Kirby sole executor of this my last Will & Testament, desiring him faithfully to execute the same agreeable to true intent and meaning thereof.

"In witness whereof I have hereunto set my hand and Seal this twenty second day of March, in the year of our Lord one thousand eight hundred and twenty two 1822.

"Signed sealed and declared by the said
David Kirby to be his last will & testament David Kirby    S. S.
at whose request & in whose presence & in
presence of each other, we hereto set our
names as witnesses

"At a Court of Probate Holden at New Bedford in and for the County of Bristol, in the first day of May AD 1832.  Then before the Honorable Hodijah Baylies, Judge of the Probate of Wills, &c, for said County, came Isaac W. Brownell, William Case and Nathan C. Brownell all the witnesses to the foregoing instrument purporting to be the last Will and testament of David Kirby late of Westport in said County deceased, who made oath that they were present and saw the said instrument to be his last will and Testament and that they subscribed their names together, as witnesses to the execution thereof, in the said testators presence, and that he was then to the best of their judgment of sound and disposing mind & public notice having been given as ordered *& no one appearing to object I do therefore approve and allow of the said instrument as the last Will & Testament of the said deceased and do decree that it have full force and effect as such.  Given under my hand and the seal of the said Court of Probate on the day above written.
H. Baylies"

"By the Honourable Hodijah Baylies Judge of the Probate of Wills and for granting Letters of Administration within the County of Bristol aforesaid.

"Know ye, that upon the day of the date hereof at New Bedford in the county aforesaid an instrument purporting to be the last will & testament of David Kirby late of Westport in said county, deceased (a copy whereof is hereunto annexed) was presented to me and proved. Know ye therefore, that I do, by virtue of the power and authority given to me by the laws of the said commonwealth, hereby commit the execution thereof in all things the same concerning, unto Ichabod Kirby the Executor in the same Will named, well and faithfully to execute the same and to administer the estate of the said deceased according thereto; who accepted the said trust, and gave bond to pay debts and legacies and render a just and true account of the proceedings, when thereunto lawfully required.  In testimony whereof, I have hereunto set my hand and the seal of my office the first day of May AD 1832.
