Amanuensis Monday -- 1808 Mortgage Deed of Nathan Gates to Merari Spaulding in Gardner, Massachusetts

This week's document for Amanuensis Monday is the 1808 mortgage deed of  Nathan Gates selling land to Merari Spaulding in Gardner, Massachusetts in the Worcester County, Massachusetts Land Records:

                               Know all men by these presents that I Nathan Gates of Gardner in the
County of Worcester & Commonwealth of Massachusetts Yeoman in consideration of
seven hundred dollars paid me by Merari Spaulding of Westminster in the County and
Commonwealth aforesaid Yeoman the receipt whereof I hereby acknowledge do hereby
give grant sell and convey unto the said Merari Spaulding his heirs and assigns forever
a certain tract of land lying and being in the southeasterly part of the Town of Gardner afore-
said containing sixty acres be the same more or less and is bounded as follows (viz) begining

northerly on land of John Miles easterly on land of said Miles & forth division land
southerly on land of Aaron Wood & David Read westerly on land of Moses Sanderson & a
Town road and on lane of John Miles, said land has a house & barn thereon standing
said land is part of lot No. 55 third division and part of lot No. 111 second division & part
of Lort No. 91 third division.

                                 To have and to hold the same to the said Merari Spaulding his heirs
and Assigns to his and their use and behoof forever and I do covenant with the said Mera-
ri Spaulding his heirs and Assigns that I am lawfully seized in fee of the premises that
they are free of all incumbrances and that I will warrant & defend the same to the
said Merari Spaulding heirs and assigns for ever against the lawful claims & demands
of all persons.                                                         The condition of this deed is such
that whereas the said Nathan Gates has given a promissory Note of hand to the said Merari
Spaulding of the sum of three hundred and forty dollars and ninety eight cents to be paid
in one year from the date of this deed said Note bears the same date of this instrument
and is on interest.  Now know that if the said Nathan Gates his heirs executors or admin-
istrators shall well and truly pay or cause to be paid the full contents of said Note of hand
with the interest by the time above mentioned to the said Merari Spalding his heirs Ex-
ecutors Administrators or Assigns then this deed is to be void & none effect other wise
to be and remain in full force and virtue.   In witness whereof I the said Nathan
Gates have hereunto set my hand and seal this twenty second day of Sept. A.D. 1808.

contents of the within mortgage deed and order the same to be discharged on record at the Register of deeds
office within & for the County of Worcester given under my hand and seal this twenty eighth day of August
in the year of our Lord one thousand eight hundred and eleven -- Merari Spaulding.  {seal}

In this deed, Nathan Gates sold a 60 acre tract of land in southeastern Gardner to Merari Spaulding of Westminster for 700 dollars in a mortgage deed conditioned on Nathan Gates paying a debt of $340.98 with interest to Spaulding within one year from 22 September 1808.  Gates satisfied the debt on 28 August 1811 and the deed was voided by Spaulding.

Nathan Gates (1767-1830), who married Abigail Knowlton (1774-1855) in 1790, is my 4th great-grandfather.  I am descended from their daughter, Abigail Gates (1797-1867) who married Benjamin Seaver (1791-1825) in 1817.
