Amanuensis Monday -- 1900 Judgment to Distribute Estate of Malina Seaver (1831-1898) of Stoughton, Wisconsin

STATE OF WISCONSIN
COUNTY COURT FOR DANE COUNTY

In the Matter of Malina      :
Seaver,                                :  IN PROBATE.
                    Deceased.        :

                                                           At September Term, 1900.
                                                           September 4 1900

Jennie Brooks, the Administratrix of the estate of Malina Sea-
ver, deceased, late of the city of Stoughton in said County of Dane
having on the 31st. day of July, 1900, filed in said Court her fi-
nal accounts as such administratrix, together with her petition,
praying among other things for judsgment adjusting and allowing her
said accounts, and assigning the residue of said estate to the per-
sons entitled thereto; And on the 31st. day of Judy, 1900, an Order
having been made by said Court, that said accounts be examined and
adjusted, and the matter of said petrition be decided at the Regular
Term of said court, to be held on the First Tuesday of September,
1900 at the opening of the Court, on that day, or as soon thereaf-
ter as said matter could be heard, and that notice thereof be given
to all persons interested by publication of said Order three suc-
cessive weeks before said Term in the Stoughton Hub, a newspaper
published in said Dane County; And it appearing by due proof that
due notice by publication of said Order has been given as required
by law and said order.

And, on the 5th. day of September, 1899, an order having been
duly made by said Court limiting the time for creditors of the
said Malina Seaver deceased, to present their claims against said
Malina Seaver deceased, and appointing time and place, when and
where the said Court would receive, and examine and adjust such
claims; and due notice having been given, as required by law, and
the Order last aforesaid, of the time so limited for presenting
such claims, and of the time and place so appointed for the exam-
ination and adjusting of the same; and the time so limited for the
presentation of such claims having expired on the 5th. day of March
1900; and no claims having been presented against said Malina Se-
aver, deceased;  And upon the examination of he accounts of such Ad-
ministratrix, the Court finds:

First. - That the amount of property chargeable to said Ad-
ministratrix is $1939.50.
Second. - That the amount properly allowed and creditd to her
is, $277.25.
Third. - That the residue in her hand consists of $1662.25.
Fourth. - That said Malina Seaver, deceased, died seized of the
following described real estate to-wit; Lot number eight (8) in
block number nine (9) of the village of Waucoma, now village of
Cooksville, in Rock County, Wisconsin. according to the recorded
plat of said village of Waucoma, now village of Cooksville.
Fifth. - That said deceased left surviving her Jennie Brooks, a
daughter, residing at Stoughton, Dane County, Wisconsin, and Clara
Bird, a daughter, residing at Yreka, California, of full age, as
her only heirs at law.

WHEREFORE, IT IS ORDERED AND ADJUDGED, that the account of
said administratrix, as stated as aforesaid, be, and the same is hereby allowed.

That the said sum of Sixteen hundred and sixty two and 25/100
Dollars, the residue of said personalestate now in the hands of
the administratrix, be, and is hereby assigned to Jennie Brooks
and Clara Bird, daughters of said deceased, toeach one half there-
of, amounting to Eight hundred eleven and 2/100 Dollars to
each.

IT IS FURTHER ORDERED AND ADJUDGED, that the real estate a-
foresaid, be, and the same is hereby assigned to Jennie Brooks
and Clara Bird, as the only heirs at law of Malina Seaver, deceased
to each the undivided one half thereof.

IT IS FURTHER ORDERED AND ADJUDGED, that said estate is full
adminsitered and settled.

This petition is a Derivative Source (because it is a court clerk's typewritten record with handwritten dates), Primary Information and Direct Evidence of the judgment of the court judge to distribute the estate of Malina Seaver, deceased, of Stoughton, Wisconsin in the Dane County, Wisconsin probate court, which defines the real estate and personal property and lists the two heirs-at-law of Malina Seaver, her daughters Jennie Brooks (the administratrix) and Clara Bird.

Malina (Shepard) Seaver (1831-1898) was born in 1831 in New York state.  She died 31 January 1898 in Cooksville, Rock County, Wisconsin.  She married William Franklin Seaver (1825-1886) before 1850 perhaps in  New York state or Wisconsin.  They had two children:
 
*  Clara L. Seaver (1851-1924), married 1874 John William "J.W." Bird (1843-1927).
*  Jane B. "Jennie" Seaver (1858-1960), married 1882 Charles A. Brooks (1848-1932). 

I am a 3th cousin 5 times removed to William Franklin Seaver (1825-1886), with the common Seaver ancestor being my 7th great-grandfather Joseph Seaver (1672-1754).
