Amanuensis Monday -- 1885 Will of George Arthur Seaver (1830-1899) of Brooklyn, New York and New Orleans, Louisiana.

 This week's document for transcription is the 1885 will of George Arthur Seaver, in the Kings   County, New York Surrogate Court records.

On reading and filing the petition of John A.
Warren, attorney for Margaret Ford Seaver deceased filed
the 25th day of May 1905, the exemplified copy of the
records of the last Will and Testament of George
Arthur Seaver deceased, and the proofs and
record of the probate thereof in the office of the
Clerk of the Civil District Court for the Parish of
Orleans, State of Louisiana, the exemplified copy
of Letters Testamentary issued to Margaret Ford
Seavers as Executrix of the last Will and Testament
of George Arthur Seaver deceased, and the records
thereof in the office of the Clerk of the Civil
District of the Parish of Orleans, State of Louisiana,
Now in Motion of John A. Warren attorney
for petitioner, it is,

Ordered that the exemplified copy of the
last Will and Testament of George Arthur Seaver
deceased and the exemplified copy of the records
and proofs thereof n the office of the Clerk of the
Civil District Court for the Parish of Orleans, State
of Louisiana, and the exemplified copy of the Letters
Testamentary issued to Margaret Ford Seaver,
Executrix of the last Will and Testament of George
Arthur Seaver deceased, and the records thereof
in the office of the Clerk of the Civil District Court
for the Parish of Orleans, State of Louisiana, be filed
and recorded in the Surrogate's office of the County of
Kings, State of New York.

Will
       In the Name of God, Amen.
I, G. Arthur Seaver of Brooklyn, State of New York,
being of sound mind and memory, and considering
the uncertainty of this frail and transitory life, do
therefore make, ordain, publish and declare this
to be my last Will and Testament.  That is to say,
First, after all my lawful debts are paid and
discharged, I give and bequeath all my Estate and
Property real and personal and mixed to my wife
Margaret Ford Seaver of which I may die seized
and possessed and to which I may be entitled at
the time of my death and in case of the birth here-
after of any offspring being born to us such off-
spring to be supported, nourished clothed and
properly educated by my said wife from any bequests
to her.

Likewise, I make, constitute and appoint my said
wife to be sole Executrix o this my last Will and
Testament without bond being required of her for
the faithful performance of this trust, hereby revoking
all former Wills by me made.

In Witness Whereof, I have hereunto
subscribed my name and affixed my seal, the
Sixteenth day of July in the year of our Lord
one thousand eight hundred and eighty-five.

The above written Instrument was subscribed by
the said G. Arthur Seaver in our presence and
acknowledged by him to each of us, and he at

our names our respective places of residence.
The words above "X ?????? were interlined before
the execution of this Will.

Affidavit:
Margaret Ford, Widow George Arthur Seaver
and William G. Wheeler being sworn say:  That they
have been presented with an instrument partly
printed and partly written on a double sheet of
white paper beginning with the words "In the
name of God Amen and ending with the signature
of G. Arthur Seaver" purporting to be the last
Will and Testament of said G. Arthur Seaver dated
July 16" 1885 witnessed by J.P. Noues and Simeon
Steinheimer followed by a Codicil dated New Orleans
December 27th 1895; that they are well acquainted
with the handwriting and signature of the said
George Arthur Seaver for having often seen him
write and sign his name; that all the written
portion of said will and the whole of the Codicile
are in the handwriting of the said George Arthur Seaver
and that the signature of said George Arthur Seaver
affixed to the will and to the Codicile are the genuine
signatures of said George Arthur Seaver
Sworn to me and subscribed this

Judgment:

The Court considering that the two documents
dated July 16" 1885 and December 27" 1896 signed
"G. Arthur Seaver" mentioned in the petition herein
and annexed thereto are the last will and testament
and Codicile of said George Arthur Seaver and the
handwriting and signature thereon have been
proved to be the genuine handwriting and signature
of said George Arthur Seaver.

It is Ordered, adjudged and decreed that the said
last Will and Testament and Codicile of the said George
Arthur Seaver be declared proved and that the
same be filed and recorded in the Clerks office of
this Court and that the Executrix thereof be ordered
and take place according to law; that petitioner
Margaret Ford Widow George Arthur Seaver be
appointed and confirmed Executrix of said will
and that letters issue to her on her taking the
oath required by law and that Chas. T Souiat be
appointed to make an Inventory of all the property
left by the deceased.

George Arthur Seaver (1830-1899) was born 17 July 1830 in New York City, New York, the son of William Whitney and Hannah Hewes (Hunneman) Seaver.  He died 12 October 1899 in New Orleans, Louisiana.  He married Margaret Ford (1849-1928) on 2 June 1885 in Norfolk, Virginia.  They had three children:

*  George Arthur Seaver (1886-1945), married 1921 Nellie J. Fischer (1891-1978).
*  Edward Ford Seaver (1888-1966).
*  Margie Seaver (1891-????), married 1916 Ira Arthur Roussell (1881-????).

The pages above are a Kings County, New York Surrogate's Court clerk's typescript copy, transcribed to the court record book and therefore a Derivative Source (although there was testimony that the original will filed in the court was transcribed carefully and exactly),  It is Primary Information and Direct Evidence of the relationships, dates and places noted therein.  Since George Arthur Seaver died in New Orleans, Louisiana, his estate was probated there and the records were provided to the King's County Surrogates Court.

It appears that George Arthur Seaver wrote his will soon after his marriage to Margaret Ford in 1885 at age 55 (and she was age 35), and before they had any children..

I am a sixth cousin four times removed to George Arthur Seaver (1830-1899), with the common Seaver ancestor being 9th great-grandfather Robert Seaver (1608-1683).
